22. Congratulates Sweden, Belgium, France, Slovenia, Denmark and the United Kingdom on achieving the Barcelona objectives and calls on the other Member States to continue their efforts; calls on the Member States to go beyond the Barcelona objectives by adopting a more systematic and integrated approach, to be implemented jointly by national and local authorities, to education and preschool care services, in particular for very young children under the age of three; calls on the Commission to provide continuing financial support to Member States so that they can offer childcare systems – in particular by means of crèches – that parents can afford, including through the establishment of these facilities in the workplace; believes that the right balance can be struck between family plans, private life and professional ambitions only if the people concerned have genuine freedom of choice, in economic and social terms, and are supported by political and economic decisions at EU and national level without being penalised, and if the requisite infrastructure is in place; calls on the Member States to increase their child support budgets, specifically by expanding public networks of day care centres, nurseries and services which offer extracurricular activities for children; calls also on the Commission to address the lack of affordable childcare facilities in its CSRs;
22. félicite la Suède, la Belgique, la France, la Slovénie, le Danemark et le Royaume-Uni d'avoir atteint les objectifs de Barcelone et demande aux autres États membres de continuer leurs efforts dans cette voie; demande aux États membres d'aller au-delà de ces objectifs, en adoptant une approche plus systémique et intégrée en matière d'éducation et de services de prise en charge préscolaires entre les autorités nationales et locales, en particulier pour les très jeunes enfants de moins de trois ans; demande à la Commission de continuer à apporter son soutien financier aux États membres pour offrir des systèmes de garde, en particulier des crèches, abordables aux parents, également par la création de ces structures sur le lieu de travail; estime que la conciliation des projets familiaux, de la vie privée et des ambitions professionnelles n’est possible que si les personnes concernées sont, sur le plan économique et social, réellement libres de choisir et bénéficient du soutien apporté par l’adoption de décisions politiques et économiques aux niveaux européen et national, sans qu'il en découle un désavantage et si les infrastructures indispensables sont disponibles, invite les États membres à augmenter les budgets consacrés à l'accueil des enfants, notamment par le renforcement du réseau public de garderies, de crèches et de services publics d'activités de loisirs pour les enfants; demande également à la Commission d'aborder la question de l'absence de services de garde d'enfants abordables dans les recommandations spécifiques par pays;

(12a) Considering that by virtue of Protocol (No 15) on certain provisions relating to the United Kingdom of Great Britain and Northern Ireland, the reference values mentioned in Protocol (No 12) on the excessive deficit procedure are not directly binding on the United Kingdom, the obligation to have in place numerical fiscal rules that effectively promote compliance with the specific reference values for the excessive deficit, and related obligation for the multi-annual objectives in medium-term budgetary frameworks to be consistent with such rules, should not apply to the United Kingdom.
(12 bis) Étant donné qu'en vertu du protocole (n° 15) sur certaines dispositions relatives au Royaume-Uni de Grande-Bretagne et d'Irlande du Nord, les valeurs de référence visées au protocole (n° 12) sur la procédure concernant les déficits excessifs ne sont pas directement contraignantes pour le Royaume-Uni, l'obligation de disposer de règles budgétaires chiffrées aidant effectivement à se conformer aux valeurs de référence spécifiques concernant les déficits excessifs, et l'obligation qui en découle pour les objectifs pluriannuels des cadres budgétaires à moyen terme de respecter ces règles, ne devraient pas s'appliquer au Royaume-Uni.

In the light of these texts, the Court of Justice has ruled that Article 37 is the appropriate legal basis for any legislation concerning the production and marketing of agricultural products listed in Annex II to the Treaty which contributes to the achievement of one or more of the objectives of the common agricultural policy set out in Article 33 of the Treaty (see in particular the judgment of 23 February 1988 in Case C-68/86 United Kingdom v Council and the judgment of 23 February 1998 in Case C-131/86 United Kingdom v Council).
La Cour de justice, au vu de ces textes, a jugé que l'article 37 constitue la base juridique appropriée pour toutes les réglementations concernant la production et la commercialisation des produits agricoles énumérés à l'annexe II du traité, qui contribuent à la réalisation d'un ou plusieurs des objectifs de la politique agricole commune énoncés à l'article 33 du traité (cf. notamment l'arrêt du 23 février 1988, Royaume Uni c/ Conseil, affaire 68/86, et l'arrêt du 23 février 1988, Royaume Uni c/ Conseil, affaire 131/86).
