When applying this Regulation, Member States shall act in full compliance with relevant Union law, including the Charter of Fundamental Rights of the European Union ("the Charter of Fundamental Rights"); relevant international law, including the Convention Relating to the Status of Refugees done at Geneva on 28 July 1951 ("the Geneva Convention"); obligations related to access to international protection, in particular the principle of non-refoulement; and fundamental rights.

-guaranteeing the protection of fundamental rights in the performance of the Agency's and Member Statets' tasks under the Regulation in accordance with relevant Union law, including in particular the Charter of Fundamental Rights of the European Union, including setting up of a complaint mechanism to handle complaints concerning possible violations of fundamental rights in the course of activities carried out by the European Border and Coast Guard Agency.

The instrument hereby established is intended to contribute to achieving the objectives of the Union's external action, including those of its development policy, in particular the objectives set out in the Joint Statement by the Council and the representatives of the Governments of the Member States meeting within the Council, the European Parliament and the Commission on European Union Development Policy entitled ‘The European Consensus’ and in the Commission Communication of 13 October 2011 entitled ‘Increasing the Impact of EU Development Policy: an Agenda for Change’, and the Union's policies relating to human rights, including the objectives outlined in the EU Strategic Framework and Action Plan on Human Rights and Democracy, adopted by the Council on 25 June 2012.

contribute to the implementation in the region of the Union's policies relating to human rights in cooperation with the EUSR for Human Rights, including the EU Guidelines on human rights, in particular the EU Guidelines on Children and Armed Conflict, as well as the EU Guidelines on violence against women and girls and combating all forms of discrimination against them, and the Union's policies relating to women, peace and security, including by monitoring and reporting on developments, as well as formulating recommendations in this regard, and maintain regular contacts with the relevant authorities in Mali and in the region, the Office of the Prosecutor of the International Criminal Court, the Office of the High Commissioner for Human Rights and the human rights defenders and observers in the region;

5. An employed person who is a national of a Contracting Party and is employed in the territory of the other Contracting Party shall enjoy equal treatment in terms of membership of trade union organisations and exercise of union rights, including the right to vote and right of access to executive or managerial positions within a trade union organisation; he may be precluded from involvement in the management of public law bodies and from holding an office governed by public law.
5. Un travailleur salarié ressortissant d'une partie contractante, occupé sur le territoire de l'autre partie contractante, bénéficie de l'égalité de traitement en matière d'affiliation aux organisations syndicales et d'exercice des droits syndicaux, y compris le droit de vote et l'accès aux postes d'administration ou de direction d'une organisation syndicale; il peut être exclu de la participation à la gestion d'organismes de droit public et de l'exercice d'une fonction de droit public.
