Where European Standardisation Organisations' standards setting technical specifications of a fuel do not include labelling provisions for compliance with the standards or if the labelling provisions do not refer to a graphical expression including colour coding schemes, or if the labelling provisions are not suitable for reaching the objectives of this Directive, the Commission may, for the purposes of the uniform implementation of paragraphs 1 and 2, mandate European Standardisation Organisations to develop compatibility labelling specifications or adopt implementing acts determining the graphical expression, including a colour coding scheme, of compatibility for fuels introduced in the Union market and reaching the level of 1% of the total volume of sales, in the assessment of the Commission, in more than one Member State.
4. Lorsque les normes des organisations européennes de normalisation établissant des spécifications techniques pour un carburant ne comportent pas de dispositions en matière d'étiquetage concernant la conformité aux normes ou si les dispositions en matière d'étiquetage ne mentionnent pas une expression graphique, notamment des systèmes de code de couleurs, ou si les dispositions en matière d'étiquetage ne sont pas appropriées pour atteindre les objectifs de la présente directive, la Commission peut, afin d'assurer la mise en œuvre uniforme des dispositions des paragraphes 1 et 2, charger les organisations européennes de normalisation de définir des spécifications d'étiquetage concernant la compatibilité pour les carburants introduits sur le marché de l'Union qui, selon l'estimation de la Commission, représentent au moins 1 % du volume total des ventes de carburants dans plus d'un État membre, ou adopter des actes d'exécution déterminant l'expression graphique, y compris un système de code de couleurs, concernant la compatibilité de ces carburants.

Where ESO standards setting technical specifications of a fuel do not include labelling provisions for compliance with the standards in question, where the labelling provisions do not refer to a graphical expression including colour coding schemes, or where the labelling provisions are not suitable for attaining the objectives of this Directive, the Commission may, for the purposes of the uniform implementation of paragraphs 1 and 2, mandate ESOs to develop compatibility labelling specifications, or may adopt implementing acts determining the graphical expression, including a colour coding scheme, of compatibility for fuels introduced in the Union market which reach the level of 1 % of the total volume of sales, in the assessment of the Commission, in more than one Member State.

(2) Whereas the internal market comprises an area without internal frontiers in which the free movement of goods, persons, services and capital is guaranteed; whereas free movement of goods concerns not only transactions by persons acting in the course of a business but also transactions by private individuals; whereas it implies that consumers resident in one Member State should be free to purchase goods in the territory of another Member State on the basis of a uniform minimum set of fair rules governing the sale of consumer goods;
(2) considérant que le marché intérieur comporte un espace sans frontières intérieures dans lequel la libre circulation des marchandises, des personnes, des services et des capitaux est assurée; que la libre circulation des marchandises concerne non seulement le commerce professionnel, mais également les achats effectués par les particuliers; qu'elle implique que les consommateurs résidant dans un État membre puissent s'approvisionner librement sur le territoire d'un autre État membre sur la base d'un socle minimal commun de règles équitables régissant la vente de biens de consommation;
