The General Court erred in starting from the premiss that the marks under comparison were structurally different on the basis that the initial syllable of UniCredito Italiano SpA’s marks is followed by an element in English, whereas the initial syllable of the appellant’s marks is followed by one in German.
En dénaturant les faits, le Tribunal a estimé que les marques en cause se distinguaient au niveau structurel, au motif que, dans les marques demandées à l’enregistrement, la syllabe initiale est liée à un élément en langue anglaise, tandis que, dans les marques de la partie requérante, la syllabe en question est liée à un élément en langue allemande.
