If, despite the measures taken by the home Member State or because those measures prove inadequate or are lacking in that State, the undertaking persists in violating the legal provisions in force in the Member State concerned, the latter may, after informing the competent authorities of the home Member State, take appropriate measures to prevent or penalize further irregularities, including, in so far as is strictly necessary, preventing that undertaking from continuing to conclude new assurance contracts within its territory.
5. Si, en dépit des mesures ainsi prises par l'État membre d'origine ou parce que ces mesures apparaissent inadéquates ou font défaut dans cet État, l'entreprise persiste à enfreindre les règles de droit en vigueur dans l'État membre concerné, ce dernier peut, après en avoir informé les autorités compétentes de l'État membre d'origine, prendre les mesures appropriées pour prévenir ou réprimer de nouvelles irrégularités et, pour autant que cela soit absolument nécessaire, empêcher l'entreprise de continuer à conclure de nouveaux contrats d'assurance sur son territoire.
