B. PERSONS TO WHOM THIS RESOLUTION DOES NOT APPLY The harmonization principles do not apply to: - persons who have right of free movement under Community law, i.e. nationals of Member States, nationals of EFTA countries parties to the Agreement on the European Economic Area and members of their families; - third-country nationals who have been allowed admission for the purpose of family reunification to join nationals of a Member State or of a third country resident in the Member State concerned; - third-country nationals whose access to employment is covered by rights stemming from agreements governed by Community law concluded with third countries; - persons undertaking casual work in the course of youth exchange or youth mobility schemes, including "au pairs"; - persons entering Member States in order to pursue economic activities as self-employed persons or to set up and/or manage a business/undertaking which they effectively control.
B. PERSONNES AUXQUELLES LA PRESENTE RESOLUTION NE S'APPLIQUE PAS Les principes d'harmonisation ne s'appliquent pas : - aux bénéficiaires de la libre circulation des personnes en vertu du droit communautaire, à savoir les ressortissants des Etats membres, les ressortissants des pays membres de l'AELE parties à l'accord sur l'espace économique européen et les membres de leurs familles ; - aux ressortissants de pays tiers dont l'admission a été autorisée à des fins de regroupement familial pour rejoindre des ressortissants d'un Etat membre ou de pays tiers résidant dans l'Etat membre en question ; - aux ressortissants de pays tiers bénéficiaires, pour accéder à un emploi, des droits découlants d'accords régis par le droit communautaire conclus avec des pays tiers ; - aux personnes exerçant un travail occasionnel dans le cadre de programmes d'échanges ou de mobilité en faveur des jeunes, y compris les personnes au pair ; - aux personnes entrant dans les Etats membres pour y exercer des activités économiques non salariées ou afin de créer et/ou de gérer une affaire/entreprise qu'elles contrôlent effectivement.
