On 10 February 2016, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertakings Avril Pôle Animal (‘APA’, France), belonging to the Avril group (‘Avril’, France), and Tönnies International Holding Gmbh (Germany), belonging to the Tönnies group (‘Tönnies’, Germany) acquire within the meaning of Article 3(1)(b) and 3(4) of the Merger Regulation joint control of a newly created company (‘NewCo’, France) constituting a joint-venture.
Le 10 février 2016, la Commission a reçu notification, conformément à l’article 4 du règlement (CE) no 139/2004 du Conseil (1), d’un projet de concentration par lequel les entreprises Avril Pôle Animal («APA», France), appartenant au groupe Avril («Avril», France), et Tönnies International Holding Gmbh (Allemagne), appartenant au groupe Tönnies («Tönnies», Allemagne), acquièrent, au sens de l’article 3, paragraphe 1, point b), et de l’article 3, paragraphe 4, du règlement sur les concentrations, le contrôle en commun d’une société nouvellement créée («NewCo», France) constituant une entreprise commune.
