The EEA had already identified certain problems with the stock maintenance system at the public consultation stage. It pointed out that the current legal arrangements governing the maintenance of security stocks effectively obstruct imports of petroleum products, thereby confining competition for refining to the two domestic refineries. This situation arises because those refineries are not subjected to strong competitive pressure from (low) import prices and the prices which they both charge the distributing companies in Greece are higher than those in the other Member States despite the low cost of crude which the domestic refineries enjoy.

The prevailing view, I think, is that the liberalisation of the internal market in electricity and natural gas is: one, way behind schedule and is being systematically obstructed by monopoly interests on the part of the private sector, the trades union and the national governments, and not just in France; two, that there are huge differences from one country to another. For example, Great Britain has fully liberalised, while France is doing exactly the opposite and the same applies, unfortunately, to my own country; three, as a result of the foregoing, there are serious disruptions in the working of the internal market, competition is being distorted and, consequently, prices are being squeezed at the expense of competitiveness both in the energy production sector and between European companies and in the consumer sector and, four, this delay is hampering cross-border transactions on these markets.

For Henss/Isoplus, the Commission must take into account two additional aggravating factors, namely 1. the leading role played by this undertaking in the enforcement of the cartel and 2. the systematic attempt to mislead the Commission as to the true relationship between the companies of the group; this constituted a deliberate obstruction of the Commission's investigations which, had it succeeded, might well have allowed the undertaking to evade the appropriate penalty and/or rendered its recovery more difficult.
Pour ce qui se rapporte à Henss/Isoplus, la Commission doit tenir compte de deux circonstances aggravantes supplémentaires, à savoir le rôle de premier plan joué par cette entreprise dans la mise en oeuvre de l'entente et ses tentatives répétées pour tromper la Commission sur la véritable nature des relations entre les entreprises du groupe.
