Commends the Turkish Constitution Conciliation Committee for its commitment to drafting a new Constitution and for the inclusive process of consulting civil society in a manner that reflects the diversity of Turkish society; expresses concern at the apparently slow progress made by the Committee so far; encourages the Committee to continue its work and to tackle – in an inclusive, representative and collegial way, and in line with the criteria and values of the EU – key issues such as (a) ensuring the separation of powers and an adequate system of checks and balances; (b) clarifying relations between the state, society and religion; (c) introducing an inclusive system of governance that secures the human rights and fundamental freedoms of all citizens; and (d) formulating an inclusive concept of citizenship; calls on all political parties, and on the actors concerned, to take a constructive approach in the negotiation of the new Constitution; is of the opinion that the involvement of, and dialogue with, the Venice Commission would produce positive results and support the constitutional process;

having regard to the Convention on the Elimination of Discrimination Against Women (CEDAW) and its Optional Protocol, which form part of international law and to which Turkey has been party since 1985 and 2002 respectively, and having regard to Article 90 of the Turkish Constitution, which states that international law takes precedence over Turkish national law,

whereas the Commission has emphasised in its 2010 and 2011 progress reports on Turkey that sustained further efforts are needed to convert the existing legal framework into political, social and economic reality; whereas the Commission has further stated that gender equality, fighting violence against women, including honour killings, and combating early and forced marriages remain major challenges for Turkey; whereas gender equality, women's rights and gender mainstreaming should be upheld in the new Turkish Constitution which is to be drafted;

Urges the Government to uphold the rights of freedom of assembly and freedom of association enshrined in Articles 33 and 34 of the Turkish Constitution; deplores and condemns, in this context, the violent police crackdown on student demonstrations at Ankara University in December 2010;
demande instamment au gouvernement de veiller au respect des libertés de réunion et d'association, consacrées par les articles 33 et 34 de la constitution turque; à cet égard, déplore et condamne la brutale répression policière des manifestations étudiantes à l'université d'Ankara en décembre 2010;

5. Considers it to be of fundamental importance that the new Turkish Constitution should fully protect human rights and fundamental freedoms and guarantee the separation of powers and the democratic and secular character of the Turkish State; is concerned, in this context, about the opposition of the governing AKP party to the inclusion in the Constitution of a provision which explicitly makes it no longer a criminal offence to convert to a different religion, and expresses its concern about the decision by the AKP government to abolish, in the Constitution, the traditional ban on wearing headscarves at Turkish universities and other higher-education establishments; points out that, in the European Union countries, freedom of religion applies unconditionally but that religious practices are a private matter and are conducted in private; fears that abolition of this ban is a significant step towards the further Islamisation of Turkey; observes in this context that the army continues to present itself as the guardian of the secular character of the Turkish State;

It is our understanding that the Court's decision was taken on the grounds that providing multilingual municipal services to the general public is not in line with the Turkish constitutional principles, that the language of the State is Turkish and that no language other than Turkish shall be taught as a mother tongue (Articles 3 and 42 of the Constitution respectively).
