In effect, if it were correct that the Commission lacked the competence to repeal its Decision 2002/827/ECSC after the expiry of the ECSC Treaty, it would follow according to the same logic that neither was the Court competent to annul a ECSC Decision after the expiry of the said Treaty.

The Amsterdam European Council did not accept the possibility of returning the ECSC assets to the Member States but in its resolution on growth and employment called on the Commission to make appropriate proposals to ensure that upon expiry of the ECSC Treaty in 2002 the revenue from outstanding reserves would be used for a research fund for sectors related to the coal and steel industries.

Reminds that the coal and steel sectors still employ an estimated 280,000 people in the Community, and that the importance of these sectors will increase as a result of enlargement; points out that the expiry of the ECSC Treaty will mean a dramatic drop compared to the current level of support provided to these two industries through the ECSC operating budget; considers that an integrated approach would require that all aspects of the coal and steel sectors (social, economic and environment) are taken into account and incorporated into the general budget once the ECSC Treaty comes to an end;

This was in line with the wishes already expressed by the European Parliament, the ECSC Consultative Committee and the two industries, which provided most of the ECSC assets through their levy payments.
