Article 18 of the Charter of Fundamental Rights in the European Union provides that the right of asylum is guaranteed in compliance with the rules of the Geneva Convention and in accordance with the Treaty establishing the European Community, and Article 19(2) provides that 'No one may be removed, expelled or extradited to a State where there is a serious risk that he or she would be subjected to the death penalty, torture or other inhuman or degrading treatment or punishment'.

Even as regards the application of the fundamental right of persons to move freely within the Community, it is clear from case-law that the reservation contained, in particular, in Article 48(3) of the EC Treaty allows Member States to adopt, with respect to nationals of other Member States, on the grounds of public policy, public security or public health, measures which they cannot apply to their own nationals, inasmuch as under international law they may not expel them from the national territory or deny them entry to it.
