P. whereas the legislator and often insufficiently resourced tax administrations cannot anticipate, but only react, sometimes with great delay, to the innovative tax avoidance schemes which are designed and promoted by some tax advisers, in particular from very large accountancy firms, by lawyers and by intermediary companies; whereas, in particular, experience shows that EU bodies which should prevent the introduction of new harmful tax measures (such as the Code of Conduct Group set up by Member States in 1998 or the Commission, as guardian of the Treaties) have proved incapable of countering these undesirable developments, sometimes reacting in an ineffective way or on the basis of too a limited mandate, and that many new and often aggressive tax avoidance measures or agreements, such as patent boxes, have been introduced in the EU; whereas MNCs are relying, in the EU and worldwide, on the expertise of a well-organised and skilled sector of tax advisers, as well as banks and other financial service providers, for the development of their tax avoidance schemes; whereas this sector is at the same time represented in bodies advising governments and public institutions on tax matters, such as, for instance, the EU Platform for Tax Good Governance; whereas there are concerns over the conflicts of interest that might arise from the provision by the same firms of advice to both public authorities and private MNCs;
P. considérant que les législateurs et les administrations fiscales, souvent dotées de ressources insuffisantes, ne peuvent pas agir par anticipation, mais seulement répondre, parfois avec un retard considérable, aux stratagèmes d'évasion fiscale innovants qui sont conçus et promus par certains conseillers fiscaux, notamment employés par de grands cabinets d'expertise comptable, certains avocats fiscalistes et certaines sociétés intermédiaires; qu'en particulier, l'expérience montre que les organes de l'Union qui devraient empêcher l'introduction de mesures fiscales dommageables (tels que le groupe "Code de conduite" établi par les États membres en 1998 ou la Commission en sa qualité de gardienne des traités) se sont avérés incapables de parer à ces évolutions indésirables, parfois en réagissant de manière inefficace ou sur la base d'un mandat trop restreint, et qu'une quantité massive de nouvelles mesures d'évasion fiscale souvent agressives ou d'accords, tels que les régimes fiscaux favorables aux brevets, a été mise en place dans l'Union européenne; que les multinationales font appel, dans l'Union et ailleurs dans le monde, à l'expertise d'un corps professionnel bien organisé de conseillers fiscaux qualifiés ainsi que de banques et d'autres prestataires de services financiers pour mettre au point leurs dispositifs d'évasion fiscale; que ce secteur est représenté, dans le même temps, au sein d'organismes exerçant des activités de conseil en matière fiscale auprès des gouvernements et des institutions publiques, tels que, par exemple, la plateforme de l'Union concernant la bonne gouvernance dans le domaine fiscal; qu'il existe des préoccupations eu égard aux conflits d'intérêts qui peuvent naître du fait que les mêmes entreprises fournissent des conseils à la fois aux autorités publiques et aux entreprises multinationales privées;

If action by the Union should prove necessary to attain this objective and the Treaties have not provided the necessary powers, the European Parliament and the Council, acting in accordance with the ordinary legislative procedure, may adopt provisions with a view to facilitating the exercise of the rights referred to in paragraph 1.

Si une action de l'Union apparaît nécessaire pour atteindre cet objectif, et sauf si les traités ont prévu des pouvoirs d'action à cet effet, le Parlement européen et le Conseil, statuant conformément à la procédure législative ordinaire, peuvent arrêter des dispositions visant à faciliter l'exercice des droits visés au paragraphe 1.

– having regard to the Council Decision 2005/843/EC of 8 November 2005 establishing, in accordance with Article 104(8) of the Treaty establishing the European Community, that the action taken by Hungary in response to the Council recommendation of 8 March 2005 pursuant to Article 104(7) of the Treaty is proving to be inadequate ,

– having regard to the Council Decision of 8 November 2005 establishing, in accordance with Article 104(8) of the Treaty establishing the European Community, that the action taken by Hungary in response to the Council recommendation of 8 March 2005 pursuant to Article 104(7) of the Treaty is proving to be inadequate,

If action by the Union should prove necessary, within the framework of the policies defined in the Treaties, to attain one of the objectives set out in the Treaties, and the Treaties have not provided the necessary powers, the Council, acting unanimously on a proposal from the Commission and after obtaining the consent of the European Parliament, shall adopt the appropriate measures.

Si une action de l'Union paraît nécessaire, dans le cadre des politiques définies par les traités, pour atteindre l'un des objectifs visés par les traités, sans que ceux-ci n'aient prévu les pouvoirs d'action requis à cet effet, le Conseil, statuant à l'unanimité sur proposition de la Commission et après approbation du Parlement européen, adopte les dispositions appropriées.

3. If action by the Union should prove necessary to facilitate the exercise of the right referred to in Article 20(2)(a), and if the Treaties have not provided the necessary powers, the Council, acting in accordance with a special legislative procedure, may adopt provisions concerning passports, identity cards, residence permits or any other such document.

Si une action de l'Union apparaît nécessaire pour faciliter l'exercice du droit, visé à l'article 20, paragraphe 2, point a), et sauf si les traités ont prévu des pouvoirs d'action à cet effet, le Conseil, statuant conformément à une procédure législative spéciale, peut arrêter des dispositions concernant les passeports, les cartes d'identité, les titres de séjour ou tout autre document assimilé.
