The move is motivated by three concerns: to systematise and rationalise the wide range of consultation practices and procedures, and to guarantee the feasibility and effectiveness of the operation; to ensure the transparency of consultation from the point of view of the bodies or persons consulted and from the legislator's point of view; and to demonstrate accountability vis-à-vis the bodies or players consulted, by making public, as far as possible, the results of the consultation and the lessons that have been learned.

In accordance with the Common Understanding and with a view to enhancing transparency and consultation, the Commission commits to gathering, prior to the adoption of delegated acts, all necessary expertise, including through the consultation of Member States' experts and through public consultations.

Considers that eGovernment should aim at enhancing democratic participation through transparent public consultation and involvement in the policy making process by addressing all citizens, relevant stakeholders and local authorities; calls on the Member States to introduce open mechanisms for social consultation as a permanent element of the decision-making process; take the view that Member States should also develop innovative techniques and civic participation tools in their administrations and should monitor the quality of social consultations in comparison with NGOs;

2. For the development of implementing rules the Commission may issue mandates to Eurocontrol or to another body, setting out the tasks to be performed and the timetable for this, fully in accordance with priorities and with a view to complying with the deadlines laid down in this Regulation, in consultation with the Industry Consultation Body (ICB), the Sectoral Dialogue Committee (SDC), and other interested parties, where these arrangements correspond to Commission practices on transparency and consultation procedures and do not conflict with its institutional obligations.

Concernant l'élaboration des mesures d'exécution, la Commission peut confier des mandats à Eurocontrol, ou à tout autre organe, en précisant les tâches à effectuer et le calendrier correspondant, en tenant pleinement compte des priorités et en s'efforçant de respecter les délais fixés par le présent règlement, en concertation avec l'organe consultatif de branche (OCB), le comité de dialogue sectoriel (CDS), et les autres parties intéressées, dès lors que ces dispositions sont conformes aux pratiques de la Commission en matière de transparence et de procédures de consultation et ne sont pas contraires à ses obligations institutionnelles.

In this connection, it shall endeavour to make best use of the arrangements of Eurocontrol for the involvement and consultation of all interested parties, where these arrangements correspond to Commission practices on transparency and consultation procedures and do not conflict with its institutional obligations.

In exercising its implementing powers, the Commission should respect the following principles: the need to ensure confidence in financial markets among investors by promoting high standards of transparency in those markets; the need to provide investors with a wide range of competing investments and a level of disclosure and protection tailored to their circumstances; the need to ensure that independent regulatory authorities enforce the rules consistently, especially as regards the fight against economic crime; the need for high levels of transparency and consultation with all market participants and with the European Parliament and the Council; the need to encourage innovation in financial markets if they are to be dynamic and efficient; the need to ensure market integrity by close and reactive monitoring of financial innovation; the importance of reducing the cost of, and increasing access to, capital; the balance of costs and benefits to market participants on a long-term basis (including small and medium-sized businesses and small investors) in any implementing measures; the need to foster the international competitiveness of EU financial markets without prejudice to a much-needed extension of international cooperation; the need to achieve a level playing field for all market participants by establishing EU-wide regulations every time it is appropriate; the need to respect differences in national markets where these do not unduly impinge on the cohesion of the single market; and the need to ensure coherence with other Community legislation in this area, as imbalances in information and a lack of transparency may jeopardise the operation of the markets and above all harm consumers and small investors.
