2a. Once available, the machine translations of patent applications and specifications into all languages of the Union as referred to in Article 6(3) shall be made available online and free of charge on publication of the patent application and of the granted patent.

(10) In order to promote the availability of patent information and the dissemination of technological knowledge, machine translations of patent applications and specifications into all official languages of the Union should be available as soon as possible.

3. Every two years from the sixth year calculated from the date of application of this Regulation, an objective evaluation of the availability of high quality machine translations of patent applications and specifications into all official languages of the Union as developed by the European Patent Office shall be carried out by an independent expert committee.

The cost of translating the patent into all the official languages of the Community would entail a risk of the entire Community patent project foundering, placing as it would too heavy a burden on inventors, above all small and medium-sized enterprises.
Le coût d'une traduction du brevet dans toutes les langues officielles de la Communauté risquerait de mettre à l'échec tout le projet de brevet communautaire. En effet, il pèserait trop lourdement sur les inventeurs, surtout sur les petites et moyennes entreprises.

Moreover, any obligation to translate the patent into all the Community languages would not necessarily guarantee easy access to this information for all economic operators established in the Community.

However, notice should be taken of certain controversial proposals which are the subject of discussion in this matter – this has already been mentioned in the House today – namely, the questions related to translations of patents made by the European Patent Office and the proposal that these translations be made into only three languages.

Translating patents exclusively into English, French and German would cause serious harm to Italian enterprises, which would have to bear extremely high costs for the technical translation of patents they file.
Le fait de traduire les brevets uniquement en anglais, en français et en allemand porterait un grave préjudice aux entreprises italiennes, qui devraient supporter des coûts extrêmement élevés pour la traduction technique des brevets qu’elles déposent.

(15) The participating Member States should give the European Patent Office certain administrative tasks relating to European patents with unitary effect, in particular as regards administration of requests for unitary effect, the registration of unitary effect and of any limitation, licence, transfer, revocation or lapse of European patents with unitary effect, the collection and redistribution of renewal fees, the publication of translations for information purposes during a transitional period and the administration of a compensation scheme of translation costs for applicants filing European patent applications in a language other than one of the official languages of the European Patent Office.
(15) Les États membres participants devraient confier à l'Office européen des brevets certaines tâches administratives dans le domaine des brevets européens à effet unitaire, notamment la gestion des demandes d'effet unitaire, l'enregistrement de l'effet unitaire et de toute décision de limitation, licence, transfert, révocation ou extinction des brevets européens à effet unitaire, la collecte et la redistribution des taxes annuelles, la publication de traductions purement informatives durant une période de transition et la gestion d'un système de compensation des coûts de traduction pour les demandeurs qui déposent leur demande de brevet européen dans une langue autre que l'une des langues officielles de l'Office européen des brevets.
