It is not, therefore, a question of transferring jurisdiction from one State to another, but of an exceptional possibility offered to the receiving Member State to take measures to protect its interest in situations of incontestable gravity, according to a precise procedure.

This would be against the above stated objective of the smooth functioning of credit transfers in the Internal Market. This would also ignore the considerable "acquis communautaire" of payment legislation or the objectives of the New Legal Framework for Payments. The Commission is therefore of the opinion that the EU should be regarded as one jurisdiction in respect of the transposition of SRVII. 4. When a Member State makes use of any of the possibilities referred to in paragraph 3, the competent authority of the executing State shall transfer jurisdiction back to the competent authority of the issuing State in case of non-compliance with a probation measure or alternative sanction if the competent authority of the executing State is of the view that a subsequent decision as referred to in paragraph 1(b) or (c) needs to be taken.
4. 2. If new criminal proceedings against the person concerned are taking place in the issuing State, the competent authority of the issuing State may request the competent authority of the executing State to transfer jurisdiction in respect of the supervision of the probation measures or alternative sanctions and in respect of all further decisions relating to the judgment back to the competent authority of the issuing State.

If the sentenced person leaves the executing State or ceases to have a lawful and ordinary residence in the executing State , the competent judicial authority of the executing State shall transfer jurisdiction in respect of the supervision of the suspensory measures and the obligations or instructions which constitute alternative sanctions and in respect of all further decisions relating to the execution of the judgment (or if appropriate the decision granting conditional release) to the competent judicial authority of the issuing State.
