TRADUCTIONS EN CONTEXTE

1. Where a traditional term is protected under this Regulation, the registration of a trademark, which corresponds to one of the situations referred to in Article 40, shall be refused if the application for registration of the trademark does not concern wines qualified to use such a traditional term and is submitted after the date of submission of the application for protection of the traditional term to the Commission and the traditional term is subsequently protected.

Lorsqu'une mention traditionnelle est protégée au titre du présent règlement, l'enregistrement d'une marque commerciale correspondant à l'une des situations visées à l'article 40 est refusé si la demande d'enregistrement de la marque ne concerne pas des vins pouvant bénéficier de ladite mention traditionnelle et si elle est présentée après la date de dépôt auprès de la Commission de la demande de protection de la mention traditionnelle et que cette demande aboutit à la protection de la mention traditionnelle.

2. A trademark, which corresponds to one of the situations referred to in Article 40 of this Regulation, and which has been applied for, registered or established by use, if that possibility is provided for by the legislation concerned, in the territory of the Community before 4 May 2002 or before the date of submission of the application for protection of the traditional term to the Commission, may continue to be used and renewed notwithstanding the protection of the traditional term.
2. Une marque commerciale qui correspond à l'une des situations visées à l'article 40 du présent règlement et qui a été demandée, enregistrée ou établie par l'usage, si cette possibilité est prévue dans la législation concernée, sur le territoire de la Communauté avant le 4 mai 2002 ou avant la date de dépôt auprès de la Commission de la demande de protection de la mention traditionnelle, peut continuer à être utilisée et renouvelée nonobstant la protection de la mention traditionnelle.
