After the debate with the Commission, the Committee on Legal Affairs took a decision not to recommend the defence of Mr Tomczak’s parliamentary immunity on the above grounds.

B. whereas Witold Tomczak is charged with insulting two police officers in the performance of their duties, in Ostrów Wielkopolski on 26 June 1999, in breach of Article 226(1) of the Polish penal code; whereas the General Prosecutor applied to the Sejm for waiver of Witold Tomczak's parliamentary immunity on 13 June 2000; whereas Witold Tomczak agreed on 4 October 2000 to be held liable in the matter, in accordance with Article 105(4) of the Polish Constitution; whereas after a number of failures by Witold Tomczak to appear at the hearings, the District Court in Ostrów Wielkopolski decided on 10 January 2005, in accordance with Article 377(3) of the Polish code of criminal procedure, to proceed with the trial in absentia;
B. considérant que Witold Tomczak est accusé d'avoir insulté deux officiers de police dans l'exercice de leurs fonctions, le 26 juin 1999, à Ostrów Wielkopolski, et ce en violation de l'article 226, paragraphe 1, du code pénal polonais; que le procureur général a demandé au parlement polonais la levée de l'immunité parlementaire de Witold Tomczak le 13 juin 2000; que Witold Tomczak a accepté le 4 octobre 2000 d'être tenu responsable dans cette affaire, conformément à l'article 105, paragraphe 4, de la constitution polonaise; que par suite du fait que Witold Tomczak n'a pas comparu à plusieurs reprises aux audiences, le tribunal de l'arrondissement d'Ostrów Wielkopolski a décidé le 10 janvier 2005, conformément à l'article 377, paragraphe 3, du code de procédure pénale polonais, de procéder à son jugement par défaut;

whereas, on the basis of the information obtained, Witold Tomczak is not protected by parliamentary immunity in respect of any of the claims which have been drawn to the attention of the President of the European Parliament,
