Third-country nationals who are in possession of a valid travel document and a single permit issued by a Member State applying the Schengen acquis in full, should be allowed to enter into and move freely within the territory of the Member States applying the Schengen acquis in full, for a period up to three months in any six-month period in accordance with Regulation (EC) No 562/2006 of the European Parliament and of the Council of 15 March 2006 establishing a Community Code on the rules governing the movement of persons across borders (Schengen Borders Code) (7) and Article 21 of the Convention implementing the Schengen Agreement of 14 June 1985 between the Governments of the States of the Benelux Economic Union, the Federal Republic of Germany and the French Republic on the gradual abolition of checks at their common borders (8) (Schengen Convention).

However, given that Regulation (EC) No 1104/2008 builds upon the Schengen acquis under the provisions of Title IV of Part Three of the Treaty establishing the European Community, Denmark, in accordance with Article 5 of the Protocol, notified the transposition of this acquis in its national law.
Néanmoins, étant donné que le règlement (CE) no 1104/2008 développe l’acquis de Schengen en application des dispositions du titre IV de la troisième partie du traité instituant la Communauté européenne, le Danemark a notifié, conformément à l’article 5 dudit protocole, la transposition de cet acquis dans son droit national.

Given that this Regulation builds upon the Schengen acquis under the provisions of Title IV of Part Three of the Treaty establishing the European Community, Denmark should, in accordance with Article 5 of the said Protocol, decide within a period of six months after the adoption of this Regulation whether it will implement it in its national law.
Le présent règlement visant à développer l’acquis de Schengen en application des dispositions du titre IV de la troisième partie du traité CE, le Danemark devrait décider, conformément à l’article 5 dudit protocole, dans un délai de six mois après l’adoption du présent règlement, s’il le transpose ou non dans son droit national.

A full exemption from the visa requirement exists already for these three categories of persons residing within the Schengen area when they enter or re-enter that area; a general exemption should be introduced for persons of those categories residing in a Member State which has not or not yet joined the Schengen area, as far as their entry or re-entry into the territory of any other Member State bound by the Schengen acquis is concerned.
Une pleine exemption à l'obligation de visa existe déjà en faveur de ces trois catégories de personnes dès lors qu'elles résident dans l'espace Schengen au moment de l'entrée (de la réadmission) dans cet espace; il convient d'introduire une exemption générale en faveur des personnes de ces catégories qui résident dans un État membre n'ayant pas ou pas encore rejoint l'espace Schengen, dès lors que cela concerne leur entrée ou leur réadmission sur le territoire d'un autre État membre lié par l'acquis de Schengen.
