1. If, for a given contract, tenders appear to be abnormally low, the contracting authority shall, before rejecting such tenders on that ground alone, request in writing details of the constituent elements of the tender which it considers relevant and shall verify those constituent elements, after due hearing of the parties, taking account of the explanations received.

Whereas the Disciplinary Committee rules on any breach of duty by the official concerned, particularly in the light of his obligations under the Staff Regulations and, more generally, compliance with EU law, and its opinion may lead the official’s institution to adopt a decision which may be favourable or unfavourable to him, the situation is entirely different with the decision to communicate information, since OLAF merely communicates to the national judicial authorities information which those authorities alone are responsible for assessing from the point of view of criminal law.

Member States shall authorise the exchange between their competent authorities of the information referred to in paragraph 2, on the understanding that, in the case of financial holding companies, mixed financial holding companies, financial institutions or ancillary services undertakings, the collection or possession of information shall not imply that the competent authorities are required to play a supervisory role in relation to those institutions or undertakings standing alone.
3. 11. Stresses that in the event of a successful stand-alone claim, subsequent proceedings by the authorities for a breach of the EC competition rules are not excluded; also reiterates that in order to encourage undertakings to compensate the victims of illicit behaviour as quickly and effectively as possible, the competition authorities are asked to take account of the compensation paid or to be paid when determining the fine that is to be imposed upon the defendant undertaking; notes that this should, however, not interfere either with the victim's right to full compensation of the damage suffered or with the need to maintain the deterrent objective of fines, and that it should not result in lengthy and uncertain settlement finality for companies; calls on the Council and the Commission explicitly to incorporate into Regulation (EC) No 1/2003 those fining principles and further improve and specify them in order to comply with the requirements of the general legal principles;
11. relève que, en cas de réussite d'une action indépendante, des poursuites par les autorités pour infraction au droit communautaire de la concurrence ne sont pas exclues; rappelle également que, afin d'encourager les entreprises à indemniser les victimes de leurs comportements illicites aussi rapidement et efficacement que possible, les autorités de la concurrence sont invitées à tenir compte des réparations payées ou à payer lorsqu'elles calculent l'amende imposée à l'entreprise défenderesse; relève toutefois que cela ne doit pas faire obstacle au droit de la victime à une réparation complète du préjudice subi ni nuire à l'objectif dissuasif des amendes et qu'il ne pourrait en résulter une incertitude prolongée en ce qui concerne la finalité du règlement pour les entreprises; invite le Conseil et la Commission à incorporer explicitement ces principes relatifs aux amendes dans le règlement (CE) n° 1/2003 et à continuer à améliorer et préciser ces principes en sorte de respecter les principes juridiques généraux;

Where a contracting authority establishes that a tender is abnormally low on grounds that the tenderer has obtained a State aid, the tender can only be rejected on those grounds alone after consultation with the tenderer where the latter is unable to prove, within a sufficient time-limit fixed by the contracting authority, that the aid in question was granted legally.
