Therefore, in the interest of administrative simplification and in order to avoid any speculative behaviour, the tariff quota concerning the import of high-quality beef originating in third countries should be managed in accordance with Articles 308a and 308b and Article 308c(1) of Commission Regulation (EEC) No 2454/93 of 2 July 1993 laying down provisions for the implementation of Council Regulation (EEC) No 2913/92 establishing the Community Customs Code (6), which lays down rules for the management of tariff quotas designed to be used following the chronological order of dates of acceptance of customs declarations.
Par conséquent, dans un souci de simplification administrative et afin d’éviter tout comportement spéculatif, il convient de gérer le contingent tarifaire relatif aux importations de viande bovine de haute qualité originaires de pays tiers conformément aux articles 308 bis et 308 ter, et à l'article 308 quater, paragraphe 1, du règlement (CEE) no 2454/93 de la Commission du 2 juillet 1993 fixant certaines dispositions d’application du règlement (CEE) no 2913/92 du Conseil établissant le code des douanes communautaire (6), qui fixe des modalités de gestion des contingents tarifaires destinés à être utilisés selon l’ordre chronologique des dates d’acceptation des déclarations en douane.

Nevertheless, operators approved in accordance with Article 7 of Commission Regulation (EC) No 952/2006 of 29 June 2006 laying down detailed rules for the application of Council Regulation (EC) No 318/2006 as regards the management of the Community market in sugar and the quota system should be able to apply for import licences for tariff quotas, irrespective of whether or not they have been involved in trade with third countries.
Néanmoins, il convient de permettre aux opérateurs agréés conformément à l’article 7 du règlement (CE) no 952/2006 de la Commission du 29 juin 2006 portant modalités d'application du règlement (CE) no 318/2006 du Conseil en ce qui concerne la gestion du marché intérieur du sucre et le régime des quotas , de présenter des demandes de certificats d’importation au titre des contingents tarifaires, qu’ils aient ou non participé à des échanges avec des pays tiers.

Changes should take into account developments and potential developments in the regime governing imports into the Community of bananas produced in third countries, in particular the move from a system governed by tariff quotas to one currently governed by a tariff-only system, subject only to a preferential quota for bananas produced in ACP countries.

(20) Whereas it is appropriate, under certain conditions, to confer on the Commission the power to open and administer tariff quotas resulting from international agreements concluded in accordance with the Treaty or from other acts of the Council; whereas, moreover, the Commission should have analogous powers concerning certain tariff quotas opened by third countries;

Whereas in order to ensure satisfactory marketing of bananas produced within the Community and of products originating in the ACP States within the framework of the Lomé Convention Agreements, while maintaining traditional trade patterns as far as possible, provision should be made for the annual openin of a tariff quota; whereas, on the one hand, imports of bananas from third countries would be subject to a tariff of ECU 100 per tonne, which corresponds to the current rate under the Common Customs Tariff, and, on the other hand, imports of non-traditional bananas from the ACP would be subject to zero duty in accordance with the abovementioned agreements; whereas provision should be made in order to ensure the adaptation of the amount of the tariff quota based on changes in Community demand recorded in the forecast supply balance;
considérant que, pour permettre une commercialisation satisfaisante des bananes récoltées dans la Communauté ainsi que des produits originaires des États ACP dans le cadre des accords de la convention de Lomé, tout en maintenant autant que possible les courants d'échanges commerciaux traditionnels, il convient de prévoir l'ouverture chaque année d'un contingent tarifaire; que, dans le cadre de ce contingent, d'une part, les importations de bananes « pays tiers » sont assujetties à la perception d'un montant de 100 écus par tonne qui correspond au droit du tarif douanier actuellement pratiqué, d'autre part, les importations des bananes « non traditionnelles ACP » bénéficient d'un droit nul conformément aux accords précités; qu'il y a lieu de prévoir une disposition afin d'assurer la modification du volume du contingent tarifaire en fonction de l'évolution de la demande communautaire constatée dans le bilan prévisionnel;

Whereas equal and continuous access to the said quota should be ensured for all importers and the rate of levy for the tariff quota should be applied consistently to all imports until the said quota is used up; whereas, in the light of the principles outlined above, a Community tariff arrangement based on an allocation between the Member States would seem to preserve the Community nature of the quota; whereas, to represent as closely as possible the actual development of the market in the said goods, this allocation should follow proportionately the requirements of the Member States calculated both from statistics of imports from third countries during a representative reference period and according to the economic outlook for the quota period in question;
