IN-CONTEXT TRANSLATIONS

Since 2001, the determination of the third countries whose nationals are subject to, or exempt from, the visa requirement has been made on the basis of the criteria laid down in recital 5 of Council Regulation (EC) No 539/2001 .

It was argued that section 4 should not be linked with the second recital of the Statute of Westminster (alteration in the law touching the succession to the Throne), but rather only with the third recital regarding U.K. Acts of Parliament extending to the Dominions.

In order to prevent the circumvention of this Directive, companies governed by Directive 2009/101/EC of the European Parliament and of the Council of 16 September 2009 on coordination of safeguards which, for the protection of the interests of members and third parties, are required by Member States of companies within the meaning of the second paragraph of Article 54 of the Treaty, with a view to making such safeguards equivalent and companies governed by the laws of third countries and having comparable legal forms should also be covered by the arrangements referred to in recital 7.

The composition of the lists of third countries in Annexes I and II to Regulation (EC) No 539/2001 should be, and should remain, consistent with the criteria laid down in recital 5 thereto.
