3. Where a plant, plant product or other object originating in or being dispatched from a third country poses a pest risk of an unacceptable level due to the likelihood that it hosts a Union quarantine pest, and that pest risk cannot be reduced to an acceptable level by applying one or more of the measures set out in points 2 and 3 of Section 1 of Annex II, the Commission shall amend the implementing act referred to in paragraph 2 accordingly to include in it that plant, plant product or other object and the third countries, groups of third countries or specific areas of third countries concerned.
3. Lorsqu'un végétal, produit végétal ou autre objet originaire ou expédié d'un pays tiers présente un risque phytosanitaire inacceptable parce qu'il est susceptible de porter un organisme de quarantaine de l'Union et que ce risque phytosanitaire ne peut être ramené à un niveau acceptable par l'application de l'une ou plusieurs des mesures énumérées à l'annexe II, section 1, points 2) et 3), la Commission modifie l'acte d'exécution prévu au paragraphe 2 en conséquence pour y inclure ledit végétal, produit végétal ou autre objet ainsi que les pays tiers, les groupes de pays tiers ou les zones spécifiques des pays tiers concernés.

1. Where, in cases other than those referred to in Article 53 of Regulation (EC) No 178/2002 and Article 249 of Regulation (EU) 2016/429, there is evidence that the entry into the Union of certain animals or goods originating from a third country, a region thereof or a group of third countries, pose a risk to human, animal or plant health or, as regards GMOs, also to the environment, or where there is evidence that widespread serious non-compliance with the rules referred to in Article 1(2) of this Regulation is taking place, the Commission shall adopt, by means of implementing acts, the measures necessary to contain such risk or put an end to the identified non-compliance.
1. Lorsque, dans des cas autres que ceux visés à l’article 53 du règlement (CE) no 178/2002 et à l’article 249 du règlement (UE) 2016/429, il s’avère que l’entrée dans l’Union de certains animaux ou biens originaires d’un pays tiers, d’une région de pays tiers ou d’un groupe de pays tiers présente un risque pour la santé humaine ou animale ou celle des végétaux, ou, dans le cas d’OGM, également pour l’environnement, ou il s’avère qu’un manquement grave et de grande ampleur aux règles visées à l’article 1er, paragraphe 2, du présent règlement survient, la Commission adopte, par voie d’actes d’exécution, les mesures nécessaires pour enrayer ce risque ou mettre fin au manquement constaté.

If it is concluded, on the basis of a risk assessment, that the plant, plant product or other object originating in the third country, group of third countries or specific area of the third country concerned referred to in paragraph 2 poses an unacceptable risk, but that that risk can be reduced to an acceptable level by applying one or more of the measures set out in points 2 and 3 of Section 1 of Annex II, the Commission shall adopt an implementing act removing that plant, plant product or other object and the third country, group of third countries or specific area of the third country concerned from the list referred to in paragraph 2 and add it to the list referred to in Article 41.
S'il ressort d'une évaluation des risques que le végétal, produit végétal ou autre objet, originaire du pays tiers, groupe de pays tiers ou zone spécifique du pays tiers concerné, visé au paragraphe 2, présente un risque inacceptable mais que ce risque peut être ramené à un niveau acceptable par l'application de l'une ou plusieurs des mesures énumérées à l'annexe II, section 1, points 2) et 3), la Commission adopte un acte d'exécution pour retirer ce végétal, produit végétal ou autre objet et le pays tiers, groupe de pays tiers ou zone spécifique du pays tiers concerné de la liste visée au paragraphe 2 du présent article et l'ajoute à la liste visée à l'article 41.

If it is concluded, on the basis of a risk assessment, that the plant, plant product or other object originating in the third country, group of third countries or specific area of the third country concerned referred to in paragraph 2 poses an unacceptable risk due to the likelihood that it hosts a Union quarantine pest, and that that pest risk cannot be reduced to an acceptable level by applying one or more of the measures set out in points 2 and 3 of Section 1 of Annex II, the Commission shall adopt an implementing act removing that plant, plant product or other object and the third countries concerned from the list referred to in paragraph 2 and add it to the list referred to in Article 40.

4. If it is concluded, on the basis of a risk assessment, that the plant, plant product or other object originating in the third country, group of third countries or specific area of the third country concerned referred to in paragraph 2, on the taxonomic level as listed in the implementing act provided for in paragraph 3 or below that level, does not pose a risk of an unacceptable level by its likelihood to host a Union quarantine pest, the Commission shall adopt an implementing act removing that plant, plant product or other object from the list referred to in that paragraph for the third countries concerned.
4. S'il ressort d'une évaluation des risques que le végétal, produit végétal ou autre objet, originaire du pays tiers, groupe de pays tiers ou zone spécifique du pays tiers concerné, visé au paragraphe 2, de niveau taxinomique tel qu'établi dans l'acte d'exécution prévu au paragraphe 3, ou d'un niveau inférieur, ne présente pas un risque inacceptable parce qu'il est susceptible de porter un organisme de quarantaine de l'Union, la Commission adopte un acte d'exécution pour retirer ce végétal, produits végétal ou autre objet de la liste visée dans ce paragraphe pour les pays tiers concernés.

2. In case a plant, plant product or other object, originating in or being dispatched from a third country, poses a phytosanitary risk of an unacceptable level by its likelihood to host a Union quarantine pest, and that risk cannot be reduced to an acceptable level by applying one or more of the measures set out in points 2 and 3 of Section 1 of Annex IV on measures and principles for the management of the risks of pests, the Commission shall amend, as appropriate, the implementing act referred to in paragraph 1, to include in it that plant, plant product or other object and the third countries, concerned.
2. Article 8 of Directive 2002/99/EC provides that when drawing up lists of third countries or regions of third countries thereof from which imports of specified products of animal origin are permitted into the Community, particular account is to be taken of certain matters, such as the health status of livestock, the regularity, speed and accuracy with which the third country supplies information on the existence of certain infectious or contagious animal diseases in its territory, in particular avian influenza and Newcastle disease and the general health situation in the third country concerned which might pose a risk to public or animal health in the Community.

2. However, in the event of an emergency situation in a third country posing a threat of a sudden inflow of nationals from that country into the Community, the Council, acting by a qualified majority on a recommendation from the Commission, may introduce, for a period not exceeding six months, a visa requirement for nationals from the country in question.
