Definition: This block contains a wide variety of disorders that differ in severity and clinical form but that are all attributable to the use of one or more psychoactive substances, which may or may not have been medically prescribed. The third character of the code identifies the substance involved, and the fourth character specifies the clinical state. The codes should be used, as required, for each substance specified, but it should be noted that not all fourth character codes are applicable to all substances. Identification of the psychoactive substance should be based on as many sources of information as possible. These include self-report data, analysis of blood and other body fluids, characteristic physical and psychological symptoms, clinical signs and behaviour, and other evidence such as a drug being in the patient's possession or reports from informed third parties. Many drug users take more than one type of psychoactive substance. Of course, this would be acceptable if these complaints had any merit, but in fact, as committee members heard, most of these complaints, 86 in total from these three offenders, were merely attempts to draw negative or unwanted attention to a staff member they did not like or a rule that they simply did not agree with.

What action has been taken as a result of these complaints? Has the number of complaints risen or fallen, and can any trends be observed in the nature and number of complaints?

One thing stands out clearly in each year's Ombudsman's report, namely, the consistently high percentage of complaints falling outside his mandate (74.8% in 2004, 75% in 2003, 72% in 2002 and 80% in 1995). Furthermore, an overwhelming majority of these complaints are not directed at a Community institution or body.

They would be unable to operate if they did not receive the necessary information within the set time periods. In our experience, the difficulties many petitioners encounter with regard to these petitions are twofold. Not only do they experience difficulty in understanding Community law – which is often complex and difficult to grasp – but they also have difficulty in obtaining from local, regional and national administrations sufficient information to enable them to submit their petitions to the Committee on Petitions in the approved manner. The same applies to complaints to the European Commission, as the Commissioner is well aware.
