The Joint Committee shall hold an exchange of views on the implications of new Community legislation amending Regulation EEC No 1210/90 or any other legal instrument referred to in this Agreement, including, if appropriate, on any expected implications relating to the financial contribution laid down in Article 2 of this Agreement and Annex II thereto.

In the event that, pending the completion of the procedures necessary for the entry into force of this Agreement, the provisions of certain parts of this Agreement, in particular those relating to the free movement of goods, are put into effect by means of an Interim Agreement between the Community and Lebanon, the parties agree that, in such circumstances, for the purposes of Titles II and IV of this Agreement and Annexes 1 and 2 and Protocols 1 to 5 thereto, the terms "date of entry into force of this Agreement" mean the date of entry into force of the Interim Agreement in relation to obligations contained in these Articles, Annexes and Protocols.

(2) Whereas this dispensation relates in particular to agreements, decisions and concerted practices where the only parties thereto are undertakings from one Member State and the agreements, decisions or practices do not relate either to imports or exports between Member States, or where not more than two undertakings are party thereto and the agreements only restrict the freedom of one party to the contract in determining the prices or conditions of business on which the goods he has obtained from the other party to the contract may be resold; whereas this dispensation does not cover mot agreements caught by Articles 81(1) of the Treaty which are entered into by two or more undertakings, each operating, for the purposes of the agreement, at a different level of the production or distribution chain, and which relate to the conditions under which the parties may purchase, sell or resell certain goods or services ("vertical agreements");
(2) considérant que cette dispense vise notamment les accords, décisions et pratiques concertées auxquels ne participent que des entreprises d'un seul État membre et qui ne concernent ni l'importation ni l'exportation entre États membres, ou les accords, décisions et pratiques concertées auxquels ne participent que deux entreprises et qui ont seulement pour effet de restreindre la liberté de formation des prix ou conditions de transaction d'une partie au contrat lors de la revente de marchandises qu'elle acquiert de l'autre partie au contrat; que ladite dispense ne couvre pas la plupart des accords visés par l'article 81, paragraphe 1, du traité, lesquels sont conclus entre deux ou plus de deux entreprises, dont chacune opère, aux fins de l'accord, à un niveau différent de la chaîne de production ou de distribution, et qui concernent les conditions dans lesquelles les parties peuvent acquérir, vendre ou revendre certains biens ou services ("accords verticaux");

(b) Where the State concerned has concluded other agreements with the Agency for the application of Agency safeguards, upon the coming into force of this Agreement for that State, the application of Agency safeguards under such agreements shall be suspended while this Agreement is in force ; provided, however, that the State's undertaking in those agreements not to use items which are subject thereto in such a way as to further any military purpose shall continue to apply.
b ) Si l'Etat intéressé a conclu avec l'Agence d'autres accords relatifs à l'application des garanties de l'Agence , l'application des garanties de l'Agence au titre de ces accords est suspendue , dès l'entrée en vigueur du présent accord pour cet Etat , tant que le présent accord est en viguer , sous réserve toutefois que l'Etat continue d'être lié par l'engagement pris aux termes desdits accords et selon lequel aucun des articles visés par ces accords n'est utilisé de manière à servir à des fins militaires .
