The negative trends can be explained by the cumulative effect of a series of factors that, acting altogether, further deteriorated the state of the Union industry which was still in a fragile situation: the continued presence of Chinese dumped imports, albeit in limited volumes as compared to the original investigation, at levels significantly undercutting Union producers' prices; a substantial decline in investment in the worldwide oil and gas industry, which is the largest market for the product concerned; and a surge of low priced imports from third countries (most notably India, but also Ukraine), which put a strong downwards price and volume pressure on the Union industry.

Having regard to the fact that imports from Croatia and Ukraine undercut substantially the Community industry prices, there is no indication that the abovementioned imports, which in the majority undercut the Community prices to a lesser extent, could break the causal link between the dumped imports from Croatia and Ukraine and the material injury suffered by the Community industry.

(31) In view of the above, the Council considers it necessary, in order to protect the interests of the Community, to impose a definitive anti-dumping duty on imports of the products concerned originating in Japan and to collect definitively the provisional anti-dumping duty imposed by Regulation (EEC) No 2516/86 (32) The Council considers, having regard in particular to the price undercutting margins detected and the prices considered necessary to cover Community producers' costs and guarantee them an adequate profit margin, that the anti-dumping duties should be fixed at the level of the overall dumping margins as definitively determined, these margins being without exception substantially lower than the price undercutting margins detected.
