As referred to in the introduction of this Communication, the objective of the European Citizens’ Initiative "One of Us" is that the EU establish a ban and end the financing of activities that presuppose the destruction of human embryos, in particular in the areas of research, development aid and public health to respect human dignity and integrity.

Article 19(3) of the Horizon 2020 Regulation states that "the following fields of research shall not be financed: research activity aiming at human cloning for reproductive purposes; research activity intended to modify the genetic heritage of human beings which could make such changes heritable; research activities intended to create human embryos solely for the purpose of research or for the purpose of stem cell procurement, including by means of somatic cell nuclear transfer".

Next, the Court examines whether the concept of ‘uses of human embryos for industrial or commercial purposes’, not patentable, also covers the use of human embryos for purposes of scientific research. Thus, with regard to the latter use, the Court notes that the grant of a patent for an invention implies, in principle, its industrial or commercial application.
La Cour examine ensuite la question de savoir si l’exclusion de la brevetabilité portant sur la notion d'« utilisations d’embryons humains à des fins industrielles et commerciales » couvre également l’utilisation à des fins de recherche scientifique. Ainsi, concernant cette dernière utilisation, la Cour observe que l’octroi d’un brevet à une invention implique, en principe, son exploitation industrielle et commerciale.

Nevertheless, the Court points out that the patentability of uses of human embryos for industrial or commercial purposes is not prohibited under the Directive where it concerns the use for therapeutic or diagnostic purposes which are applied to the human embryo and which are useful to it – for example to correct a malformation and improve the chances of life.
La Cour rappelle toutefois, que la brevetabilité des utilisations d’embryons humains à des fins industrielles ou commerciales n’est pas interdite, en vertu de la directive, lorsqu’elle concerne l’utilisation à des fins thérapeutiques ou de diagnostic qui s’appliquent à l’embryon humain et lui sont utiles – par exemple pour corriger une malformation et améliorer ses chances de vie.
