After examining the documents supplied by the Commission, the Tribunal decided, by order of 18 April 2013, to place the general guide on the file and to send the detailed guide back to the Commission, on the ground that, having read the guide the Tribunal did not consider that this was necessary for it to rule on the merits of the pleas put forward by the applicant in the present case; to agree to the Commission’s request for confidentiality regarding the marking profile, and to make communication to the applicant of the general guide and the non-confidential version of the marking profile subject to confidential treatment and to certain conditions.
Après avoir examiné les documents fournis par la Commission, le Tribunal a décidé, par ordonnance du 18 avril 2013, de verser au dossier le guide général, de renvoyer le guide détaillé à la Commission au motif que, après lecture, ce guide ne lui était pas apparu nécessaire pour se prononcer sur le bien-fondé des moyens soulevés par le requérant dans la présente affaire, d’accepter la demande de confidentialité de la Commission en ce qui concerne le profil de marquage et de soumettre la communication au requérant du guide général et de la version non confidentielle du profil de marquage à un traitement confidentiel sous conditions.

By letter received by the Registry of the Tribunal on 19 February 2013, the Commission sent the Tribunal a general guide containing instructions for examiners, a detailed guide containing instructions regarding the substance of the case study for each of the different versions, entitled ‘legal manual’, and the marking profile in the software supplied to examiners/members of the selection board for assessing the competencies of the candidates during the case study.
Par courrier parvenu au greffe du Tribunal le 19 février 2013, la Commission a transmis au Tribunal un guide général contenant des instructions aux correcteurs, un guide détaillé contenant des instructions quant à la substance de l’étude de cas selon les différentes variantes intitulé « manuel juridique » et le profil de marquage dans le logiciel mis à la disposition des correcteurs/membres du jury pour évaluer les compétences des candidats lors de l’étude de cas.

The applicant claims that the obligation on the institutions to notify each decision affecting the rights or interests of the persons concerned and to mention the means of obtaining redress and the time-limits involved stems from the general principles of Community law and from the Guide to the obligations of officials and other servants of the European Parliament (OJ 2000 C 97, p. 1, ‘the Guide to Obligations’).
