The Interim Agreement on trade and trade-related matters between the European Community, the European Coal and Steel Community and the European Atomic Energy Community, of the one part, and Turkmenistan, of the other part, together with its Annexes, the Protocol and the declarations, and the [Exchange of Letters between the European Community and Turkmenistan amending the Interim Agreement on trade and trade-related matters between the European Community, the European Coal and Steel Community and the European Atomic Energy Community, of the one part, and Turkmenistan, of the other part as regards the authentic language versions], which amends Article 31 of this Interim Agreement on trade and trade-related matters are hereby approved on behalf of the European Community.

(1) Pending the entry into force of the Partnership and Cooperation Agreement between the European Communities and their Member States, of the, one part, and Turkmenistan, of the other part, signed in Brussels on 25 May 1998, it is necessary to approve on behalf of the European Community, the Interim Agreement on trade and trade-related matters between the European Community, the European Coal and Steel Community and the European Atomic Energy Community, of the one part, and Turkmenistan, of the other part, signed in Brussels on 10 November 1999.
(1) Dans l’attente de l'entrée en vigueur de l'accord de partenariat et de coopération entre les Communautés européennes et leurs États membres, d'une part, et le Turkménistan, d'autre part, signé à Bruxelles le 25 mai 1998, il convient d'approuver, au nom de la Communauté européenne, l'accord intérimaire sur le commerce et les mesures d'accompagnement entre la Communauté européenne, la Communauté européenne du charbon et de l'acier et la Communauté européenne de l'énergie atomique, d'une part, et le Turkménistan, d'autre part, signé à Bruxelles le 10 novembre 1999.

(2) Article 31 of this Interim Agreement on trade and trade-related matters should be amended in order to take into account the new official languages of the Community since the signature of this agreement, through the conclusion of the [Exchange of Letters between the European Community and Turkmenistan amending the Interim Agreement on trade and trade-related matters between the European Community, the European Coal and Steel Community and the European Atomic Energy Community, of the one part, and Turkmenistan, of the other part as regards the authentic language versions].

I am pleased to note that the opinions of the European Parliament are similar to those of the Commission with regard to the measures to be taken to improve the fight against VAT fraud within the European Union. I am particularly happy about the widespread support for the main objective of the Commission’s first concrete proposal, namely to accelerate, by January 2010, the gathering and exchange of information concerning intra-community transactions.
Je note avec satisfaction que les avis du Parlement européen et de la Commission se rejoignent quant aux mesures à prendre pour améliorer la lutte contre la fraude à la TVA dans l’Union européenne; je me réjouis tout particulièrement du soutien général exprimé en faveur de l’objectif principal de la première proposition concrète de la Commission, à savoir accélérer, d’ici à janvier 2010, la collecte et l’échange d’informations au sujet des opérations intracommunautaires.

21. Asks that the possibility be considered of jointly presenting to the European Parliament meeting in plenary sitting for this particular purpose, the reports drawn up by the Committee on Petitions, the Ombudsman and the Committee on Legal Affairs and the Internal Market on the implementation of Community law, attended where appropriate by representatives of the national parliaments, the highest-ranking judicial authorities and Community bodies, with a view to obtaining a common view of progress made in implementing Community law;
21. demande que soit examinée la possibilité d'une présentation conjointe, en séance plénière du Parlement européen, et dans le cadre d'une réunion ad hoc, des rapports de la commission des pétitions, du Médiateur et de la commission juridique concernant la mise en œuvre du droit communautaire, le cas échéant, en présence de représentants des parlements nationaux, des plus hautes instances judiciaires et des organes communautaires, en vue de définir une approche commune concernant l'état d'avancement de l'application du droit communautaire;

To contribute to the well-being of European citizens, the Community must address in a coordinated and coherent way the concerns of its people about risks to health and their expectations for a high level of health protection. Therefore, all health-related activities of the Community must have a high degree of visibility and transparency and allow consultation and participation of all stakeholders in a balanced way, in order to promote better knowledge and communication flows and thus enable a greater involvement of individuals in decisions that concern their health.
Pour contribuer au bien-être des citoyens européens, la Communauté doit répondre d'une manière coordonnée et cohérente aux préoccupations de sa population quant aux risques sanitaires et à son attente d'un niveau élevé de protection de la santé, ce qui signifie que toutes les actions de la Communauté liées à la santé doivent avoir un degré élevé de visibilité et de transparence et permettre une consultation et une participation équilibrées de tous les acteurs concernés, de manière à promouvoir de meilleurs flux de connaissances et une meilleure communication et, dès lors, permettre une plus large participation des personnes aux décisions qui concernent leur santé.

Emphasises that the European Parliament, as the only EU body directly elected by the citizens of Europe, shares with the national parliaments control over the CFSP and hence, also, over the ESDP; recalls that the European Parliament currently performs its supervisory role by means of the right to be informed and the right to be consulted conferred on it by Article 21 of the Treaty on European Union and by means of its budgetary powers in relation to the CFSP budget which it exercises as part of the budgetary authority by virtue of Article 28 of the Treaty on European Union and the interinstitutional agreement of 6 May 1999;
3. souligne que le Parlement européen, en tant que seul organe de l'UE directement élu par les citoyens européens, partage avec les parlement nationaux le contrôle de la PESC et, de ce fait également, de la PESD; rappelle qu'à l'heure actuelle, le Parlement européen assure sa fonction de contrôle sur la base des droits d'information et d'audition que lui confère l'article 21 du traité UE, ainsi que sur la base des droits budgétaires qui lui reviennent quant au budget de la PESC en tant que branche de l'autorité budgétaire, en vertu de l'article 28 du traité UE ainsi que de l'accord interinstitutionnel du 6 mai 1999;

5. Points out that the rules governing corporate governance are generally designed to maintain a duality of power within the collegiate decision-making body by distinguishing between management and supervisory functions so as to limit conflicts of interest but stresses that non-executive structures may, besides their monitoring task, also have vital advisory, mediating and networking functions, and a particular role in linking up with societal demands and general interest. These rules are also designed to strengthen the role and rights of shareholders, in particular through better information and financial transparency. However, the recent financial scandals and the way they have affected the system as a whole offer grounds for a broader approach to matters of corporate governance; requests therefore that, in addition to the interests of institutional or individual shareholders, which are dealt with in depth in the communication, the Commission should take explicit account of the interests of all other stakeholders (employees, creditors, clients, suppliers, etc.) in the various proposals it will be submitting as part of its action plan, giving particular weight to the principle of corporate social and environmental responsibility; emphasises that decent structures and practices of information and consultation of workers form an indispensable part of European corporate governance and is of the opinion that all European company law directives should contain obligations for information and consultation of employee representatives where major decisions are at stake for the continuity of firms and jobs.
5. rappelle que les règles de gouvernement d'entreprise visent en général à maintenir une dualité de pouvoir au sein de l'organe collégial de prise de décision en distinguant les fonctions de gestion et de contrôle pour limiter les conflits d'intérêts, mais souligne que les structures non exécutives peuvent aussi avoir, outre leur mission de contrôle, des fonctions, essentielles, de consultation, de médiation et d'organisation de réseaux ainsi qu'un rôle particulier dans la mise en relation avec les demandes de la société et l’intérêt général; ces règles visent aussi à renforcer le rôle et les droits des actionnaires, notamment via une meilleure information et transparence financière; pourtant, les récents scandales financiers et leur dimension systémique justifient une approche élargie des questions de gouvernement d'entreprise ; demande en conséquence que, outre les intérêts des actionnaires, institutionnels ou individuels, qui sont largement traités dans la Communication, la Commission prenne explicitement en compte les intérêts de tous les autres stakeholders (salariés, créanciers, clients, fournisseurs...) dans les différentes propositions qu'elle sera amenée à faire dans le cadre de son plan d'action, notamment en vertu du principe de responsabilité sociale et environnementale des entreprises; souligne que des structures et pratiques correctes d'information et de consultation des travailleurs constituent une partie nécessaire du gouvernement d'entreprise européen et est d'avis que toutes les directives européennes sur le droit des sociétés devraient prévoir des obligations d'informer et de consulter les représentants du personnel lorsque des décisions importantes pour le maintien de sociétés et d'emplois sont en jeu;
