The applicant received an e-mail on 14 September 2009, reference ‘EPSO/AD/130/0[8] – Your request for written tests (b), (c), and the evaluation sheet for written test (c)’ (‘the e-mail of 14 September 2009’).

The Tribunal finds, lastly, that, even though the applicant does not put forward any argument or plea in support of the requests forming the subject-matter of the first part of the note of 28 July 2009, the fact remains that it may be inferred from the actual wording of the note of 28 July 2009 that the applicant was complaining that she had not received the documents she had asked for several times, inter alia in her e-mail of 14 May 2009, concerning written test (b), and in her e-mail of 4 July 2009 and her request for review of 10 July 2009, concerning written test (c).

In a note dated 28 July 2009, entitled ‘Complaint’, the applicant made reference to Article 90(2) of the Staff Regulations, acknowledged receipt of the letter of 23 July 2009 and stated that she had asked, without success, for a copy of her written tests (b) and (c) and of the personal evaluation sheets showing how the selection board had marked those tests; she then reiterated those requests, adding that she wished to receive any additional information concerning her in connection with her participation in the competition.
