Prof. Marc Gaudry: I think the outcome would be better and fairer for all carriers, and there are dozens of them, if the government were to invite tenders and ask: " Whose prepared to make me an offer for the rights to the Montreal—Havre-Saint-Pierre or Québec—Baie-Comeau—well not that route, because it is a profitable one" —in any case for the rights to provide service on a route that does not turn a profit" ? I don't see why we should automatically assume that the bidders would be Air Canada or Canadian.

Where the contracting authority/entity intends, under Article 69 of the Directive on public procurement or under Article 79 of the Directive on procurement by entities operating in the water, energy, transport and postal services sectors, after verifying the explanations of the tenderer, to accept an abnormally low tender comprising goods and/or services originating outside the Union, in which the value of the non-covered goods or services exceeds 50 % of the total value of the goods or services constituting the tender, it shall inform the other tenderers of this in writing, including the reasons for the abnormally low character of the price or costs charged, referring in particular to the respect of fundamental workers' rights and international law, including fundamental internationally recognized international conventions in the field of labour, social and environmental law, notably to avoid any social or environmental or taxation dumping.
