In any event, the functions performed by the applicant as a seconded national expert with the EEAS before being engaged as a temporary agent by the EEAS cannot be taken into consideration for purposes of a comparison with the functions performed in the post he occupies under the contract of employment at issue, since, as a seconded national expert, the applicant was not eligible for grading under the Staff Regulations.
En tout état de cause, les fonctions exercées par le requérant en tant qu’expert national détaché auprès du SEAE, avant d’être engagé comme agent temporaire du SEAE, ne sauraient être prises en considération aux fins d’une comparaison avec les fonctions exercées dans le poste qu’il occupe en vertu du contrat d’engagement litigieux, car, en tant qu’expert national détaché, le requérant ne pouvait pas se prévaloir d’un classement en grade par application du statut.

As regards the applicant’s first argument, the Tribunal notes that it is clear, from a simple comparison between the list of the functions to be performed by the temporary agent in grade AD 5 who was to be recruited, as given in the vacancy notice, and the list of functions in the job description for the post occupied by the applicant when he was a seconded national expert, that that argument has no basis in fact.

Notes nevertheless that the EEAS as a new organisation which represents a major European ambition needs to be endowed with sufficient means; in this regard, appropriations for staff remunerations in 2012 need to take into account the actual vacancy rates in the autumn of 2011; calls on the EEAS to exert restraint when it comes to the future creation of high-ranking posts; believes that one way of achieving this could be to replace progressively Seconded National experts posts by permanent posts for Member States' civil servants; notes that Seconded National Experts (SNE) are not counted in the one third of EEAS staff at AD level; nevertheless, recalls the Council decision establishing the organisation and functioning of the EEAS which states that "by the expiry of the contract of an SNE transferred to the EEAS under article 7, the function will be converted into a temporary agent post in cases where the function performed by the SNE corresponds to a function normally carried out by staff at AD level, provided that the necessary post is available under the establishment plan"; moreover, stresses that operational requirements for establishing the EEAS with its own information technology systems in a new building need to be funded;
