(11) This Regulation should apply to second- hand products that re-enter the supply chain in the course of a commercial activity, provided that they have been placed on the market as such, and to second-hand products originally placed on the market after the entry into force of this Regulation, and except for those second-hand products for which the consumer cannot reasonably expect that they fulfil state-of-the art safety standards, such as antiques.

The main difference between Parliament's position and the common position concerns the use of mercury in barometers. While Parliament voted in favour of a full derogation on this issue, Council proposes a time-limited derogation of two years after the entry into force of the Directive.
