Where the first TAC to be set in accordance with Articles 6 and 7 concerns a year that does not follow a year in which an egg survey has been carried out, the TAC shall be calculated pursuant to those Articles as if the latest egg survey had occurred in the preceding year.

8. The master of any vessel which has broken bulk for the purpose of lightening or other necessary purpose, previous to her arrival in the harbor of Quebec, shall, immediately on the discovery of any damaged cargo, proceed to hold a survey on the same in the manner herein prescribed, before the same shall be moved out of the place in which it was originally stowed; and if, after the arrival in port of any vessel from beyond the seas, which has not had occasion to lighten, break bulk, or otherwise discharge any portion of her cargo before coming into the harbour, the hatches of such vessel shall be first opened by any person not a Port Warden, and the cargo or any part thereof shall come from on board such ship in a damaged condition, these facts shall be primâ facie evidence that such damage occurred in consequence of improper stowage or negligence on the part of the persons in charge of the vessel, and such default shall, until the contrary be shewn, be chargeable to the owner, master, or other person interested as part owner or master of the said vessel.

Le maître de tout navire qui aura rompu son chargement pour s’alléger ou pour d’autres objets nécessaires, avant son arrivée dans le havre de Québec, devra, immédiatement après la découverte de toute avarie de la cargaison, faire faire l’inspection de ce navire en la manière prescrite par le présent acte, avant que la cargaison n’ait été dérangée de la place où elle avait été en premier lieu arrimée; et si, après l’arrivée au port de quelque navire d’outre-mer, qui n’a pas eu occasion de s’alléger, de rompre son chargement ou décharger une partie de sa cargaison avant d’entrer dans le havre, les écoutilles de tel navire sont d’abord ouvertes par toute personne autre qu’un gardien de port, et la cargaison ou toute partie d’icelle sort avariée de tel navire, ces faits constitueront une preuve primâ facie que tel dommage est dû au mauvais arrimage ou à la négligence des personnes chargées du navire, et telle faute, jusqu’à preuve du contraire, sera imputable au propriétaire, maître ou autre personne intéressée comme co-propriétaire ou maître du dit navire.
