IN-CONTEXT TRANSLATIONS

Regulation (EC) No 318/2006, which was subsequently repealed and incorporated into Council Regulation (EC) No 1234/2007 (12), replaced the variable sugar production levy system of self-financing the production quota regime by a new production charge aimed at contributing to the financing of the expenditure occurring in the sugar sector under the common market organisation for sugar.

On 29 September 2011, the General Court delivered its judgment in case T-4/06, in which it stated that there was no proper legal basis for a differentiated coefficient for the additional levy in the sugar sector and annulled Article 2 of Regulation (EC) No 1686/2005, as amended by Article 3 of Regulation (EC) No 1193/2009.

Following the publication of the European Court of Auditors’ report into the reform of the EU sugar sector in 2005-2006, which highlighted the fact that decisions were taken with regard to the sector in Ireland based on figures published in 2001 that did not reflect a restructuring of the sector in between, has the Commission any plans to address the situation, especially with regard to the possibility of aiding the re-establishment of the sugar sector in Ireland for, amongst other things, the production of biofuels, which could contribute to reaching 2020 targets?

In order to avoid hampering the restructuring of the sugar sector, it is considered necessary to provide for an exemption, at the request of the undertaking, from the withdrawal in the 2007/2008 marketing year or from a possible withdrawal in the 2008/2009 marketing year for those undertakings which in the marketing year of withdrawal concerned have successfully applied for restructuring aid under Regulation (EC) No 320/2006 and which as a result are going to renounce their total quota in the following marketing year.
Pour éviter d’entraver la restructuration du secteur du sucre, il est jugé nécessaire de prévoir une exemption, à la demande de l’entreprise, du retrait au cours de la campagne de commercialisation 2007/2008 ou d’un éventuel retrait au cours de la campagne 2008/2009 pour les entreprises qui, durant la campagne de commercialisation du retrait concerné, ont obtenu une aide à la restructuration au titre du règlement (CE) no 320/2006 et qui, par conséquent, vont renoncer à la totalité de leur quota au cours de la campagne de commercialisation suivante.

Increasing the production quota of Member States that produced C sugar in the past would not only go against the spirit of reform in the sugar sector, but may be construed as a failure to comply with the ruling of the WTO Appellate Body, which found that the European Community has been providing export subsidies to its exports of C sugar since 1995, thus breaching its obligations under the WTO Agreement on Agriculture.

The new common organisation of the markets in the sugar sector should maintain the legal status of the quotas in so far as, according to the case-law of the Court of Justice, the system of quotas constitutes a mechanism for regulating the market in the sugar sector which aims to ensure the attainment of public interest objectives.
