Contracting entities referred to in Article 6 of the Zakon o javnoj nabavi (Narodne novine broj 90/11) (Public Procurement Act, Official Gazette No 90/11) which, in accordance with special regulations, engage in the activities relating to the exploitation of a geographical area with the aim of making available sea ports, river ports and other transport terminals to operators in sea or river transport, such as the entities engaging in the said activities in accordance with the Maritime Domain and Seaports Act (Official Gazette 158/03, 100/04, 141/06 and 38/09)’.

(4) In addition to the outermost regions as defined in Article 299(2) of the Treaty establishing the European Community and the least favoured regions or islands, including rural areas, as referred to in the second paragraph of Article 158 of the Treaty, there are isolated regions, remote regions which are not easily accessible and sparsely populated regions in the European Union such as those in the northern part of Europe which have characteristics that affect the proper planning and implementation of civil protection.

In that regard, it must be stated that only such acts, duly proven, may be taken into account in order to determine whether, having regard to the likelihood of being ordered to bear those costs and to the extent of those costs (that is, the present net value of the likelihood of any such future order), a well-informed private operator would prefer to pay directly a negative price of EUR 158 million rather than run that risk.
À cet égard, il faut en effet souligner que seules de telles fautes, dûment établies, peuvent être prises en compte afin de déterminer si, eu égard au risque d’être condamné à supporter ces coûts et à l’ampleur de ceux-ci (i.e. la valeur actualisée nette du risque d’une condamnation future), un opérateur privé avisé aurait préféré payer immédiatement un prix négatif de 158 millions d’euros plutôt que de courir ce risque.
