In discussion with Transport Canada, it has been clearly stated that the intent of the environmental provisions in proposed subsection 47.1(2) are to deal with greenhouse gas emissions, yet this proposed subsection could be interpreted more broadly and runs the risk of creating jurisdictional disputes with either federal or provincial departments of the environment.

The subsection on recovery options shall set out a range of recovery options designed to respond to financial stress scenarios and which could reasonably be expected to contribute to maintaining or restoring the viability and financial position of the entity or entities covered by the recovery plan.
