If an order has been made under subsection 55(1) or 63(1) imposing a surtax that does not apply to goods imported from a free trade partner because the goods did not meet the conditions set out in subsection 59(1) or 63(4) and the Governor in Council is satisfied, on the recommendation of the Minister made as a result of an inquiry by the Canadian International Trade Tribunal, that there has been a surge of those goods on or after the coming into force of the order and that, as a result of that surge, the effectiveness of the imposition of the surtax is being undermined, the Governor in Council may, by order, make any such goods, when imported into Canada or into any region or part of Canada specified in the order during the period that the order is in effect, subject to a surtax
60. En cas de prise, en vertu des paragraphes 55(1) ou 63(1), d’un décret imposant une surtaxe qui ne s’applique pas aux marchandises importées d’un partenaire de libre-échange parce que les marchandises n’ont pas respecté les conditions prévues aux paragraphes 59(1) ou 63(4), s’il est convaincu, sur recommandation du ministre faite par suite d’une enquête du Tribunal canadien du commerce extérieur, d’une part, qu’il y a eu augmentation subite de l’importation de ces marchandises depuis l’entrée en vigueur du décret et, d’autre part, qu’en conséquence, l’efficacité de la surtaxe est diminuée, le gouverneur en conseil peut, par décret, assujettir ces marchandises à une surtaxe lors de leur importation au Canada ou dans une de ses régions ou parties précisées dans le décret, pendant la période de validité de celui-ci. Le taux de la surtaxe qui est spécifié dans le décret est soit fixe, soit variable selon que la quantité des marchandises importées au Canada ou dans une de ses régions ou parties pendant la période spécifiée est égale ou supérieure aux quantités déterminées; il ne peut dépasser le taux de surtaxe qui, de l’avis du gouverneur en conseil, suffit pour prévenir la diminution d’efficacité du décret visé aux paragraphes 55(1) ou 63(1).

Consequently, the wording of subsection 55.2(4) would no longer make sense because it makes reference to 55.2 (1) and (2), but we have repealed subsection (2).
