2. Personal data which originated in a Member State and are exchanged between Member States following a hit obtained for the purposes laid down in Article 1(2) shall not be transferred to third countries if there is a serious risk that as a result of such transfer the data subject may be subjected to torture, inhuman and degrading treatment or punishment or any other violation of his or her fundamental rights.

BG informed the Commission that according to the Bulgarian Criminal Code (Art.159c) an individual who uses a person affected by trafficking in human beings for debauchery, forced labour or begging, removal of organs, tissues, cells or body fluid or for keeping him/her in forceful subjection, regardless of his/her consent, shall be punished by deprivation of liberty of three to ten years and a fine of 10 000 to 20 000 leva.

Article 4 of the said Charter states that no one shall be subjected to torture or to inhuman or degrading treatment or punishment.

2. if the offence on the basis of which the European arrest warrant has been issued is punishable by custodial life sentence or life-time detention order, the execution of the said arrest warrant may be subject to the condition that the issuing Member State has provisions in its legal system for a review of the penalty or measure imposed, on request or at the latest after 20 years, or for the application of measures of clemency to which the person is entitled to apply for under the law or practice of the issuing Member State, aiming at a non-execution of such penalty or measure;

(13) No person should be removed, expelled or extradited to a State where there is a serious risk that he or she would be subjected to the death penalty, torture or other inhuman or degrading treatment or punishment.
