Condemns the fact that Greece is using Union Structural Funds to cover its national contributions to the Greek beneficiaries of the Artemis projects instead of providing national funding and that the Joint Undertaking acknowledged the continuation of Greek participation in Artemis projects but provides no funding to the Greek beneficiaries as an expenditure co-financed by Union Structural Funds shall not receive assistance from another Union financial instrument in accordance with Council Regulation (EC) No 1083/2006; requests the Commission to inform the discharge authority on the legality of this situation as soon as possible;

3 Acknowledges the fact that the Energy Efficiency Fund (EEEF) works by offering potential beneficiaries similar financing terms, that may be less favourable, to those offered by the ordinary market; regrets that the Fund, while in effect qualifying as a financial instrument, is considered by the Commission to be a type of subsidy, which means that EEEF beneficiaries are therefore not eligible for any aid from the structural funds; emphasises, therefore, the necessity to ensure in the future that new financial instruments are compatible with structural funds and with other subsidising instruments made available by the European Union; notes that well-functioning financial instruments in the field of energy efficiency can produce fast results, and suggests, therefore, to improve the EEEF by turning it into a revolving fund offering real opportunities in investing, directly or indirectly via financial institutions, in smaller-scale energy efficiency and renewable energy projects;
3. reconnaît que les conditions de financement proposées aux potentiels bénéficiaires par le Fonds européen pour l'efficacité énergétique (FEEE) sont semblables aux conditions offertes sur le marché ordinaire, voire moins avantageuses que celles-ci; regrette que ce Fonds, bien qu'étant dans les faits un instrument de financement, soit considéré par la Commission comme un type de subvention, ce qui signifie que ses bénéficiaires ne sont donc pas éligibles aux aides des fonds structurels; souligne, par conséquent, la nécessité de garantir à l'avenir la compatibilité des nouveaux instruments financiers avec les fonds structurels et les autres instruments de subvention mis à disposition par l'Union européenne; relève que des instruments de financement performants dans le domaine de l'efficacité énergétique peuvent produire des résultats rapidement et propose dès lors d'améliorer le FEEE en le transformant en un Fonds renouvelable offrant de véritables possibilités d'investissements directs ou indirects, par l'intermédiaire d'établissements financiers, dans des projets de petite échelle et dans le secteur des énergies renouvelables;

Emphasises that transparent and clear procedures are factors in good governance; therefore welcomes the ongoing simplification of the Financial Regulation and of the Structural Funds rules and calls on the Member States to fully comply with the requirements of the revised Financial Regulation and to disclose information on final beneficiaries of Structural Funds; urges the Commission to propose understandable rules, which will not require frequent modifications; calls for a simpler architecture for the Funds after 2013, not as a consequence of the economic crisis but as a general principle of the future cohesion policy, in order to facilitate absorption of the funds, and recommends greater transparency and flexibility in the use of the EU Funds in order to avoid an additional administrative burden which may discourage potential partners from taking part in projects;
fait remarquer que l'application de procédures claires et transparentes est un facteur de bonne gouvernance et accueille donc favorablement la simplification en cours de la réglementation des Fonds structurels; demande aux États membres de respecter pleinement les règles du règlement financier révisé et de communiquer des informations sur les bénéficiaires finals des Fonds structurels; demande instamment à la Commission de proposer des règles compréhensibles ne nécessitant pas de modifications fréquentes; demande une architecture plus simple des Fonds après 2013, non pas comme conséquence de la crise économique mais comme un principe général de la future politique de cohésion, afin de favoriser l'absorption des fonds, et préconise une plus grande transparence et souplesse dans l'utilisation des fonds de l'Union dans l'optique d'éviter les charges administratives supplémentaires de nature à décourager les partenaires potentiels de participer aux projets;

As regards the publication of beneficiaries of the Structural Funds and the Cohesion Fund, this obligation is further specified by Commission Regulation (EC) N° 1828/2006. Its Article 7 (1) (d) requires the publication of three categories of information: a) the list of the beneficiaries, b) the names of the operations and c) the amount of the public funding allocated to the operations.

In the field of structural funds, Commission Regulation (EC) No 1828/2006, which sets out the rules for the implementation of Council Regulation (EC) No 1083/2006 on Structural Funds and the Cohesion Fund, clearly puts the responsibility for collecting and publishing data of beneficiaries on the Member States and the Commission does not even receive the relevant data sets.

During 2004, the Commission carried out a fourth cycle of system audits in the beneficiary countries to assess the adequacy of the systems and procedures established for the management and control of ISPA funds and their compliance with requirements which are close to those applicable to the Cohesion Fund and the Structural Funds.

Application of the financial corrections to the beneficiaries of the Funds who do not comply with the conditions governing the grant from the Structural Funds is primarily a matter for the Member States, who will deduct the expenditure concerned from the declarations to the Structural Funds.
Les Etats membres devront appliquer en premier ressort les corrections financières aux bénéficiaires des Fonds en cas de non-respect des conditions d'attribution de la subvention des Fonds structurels et déduire les dépenses concernées des déclarations aux Fonds structurels.
