On the other hand, if it turns out that State security does stand in the way of disclosure of the grounds to the person concerned, judicial review of the legality of the decision refusing entry must be carried out in a procedure which strikes an appropriate balance between the requirements flowing from State security and the requirements of the right to effective judicial protection whilst limiting any interference with the exercise of that right to that which is strictly necessary.
En revanche, s’il s’avère que la sûreté de l’État s’oppose effectivement à la communication de ces motifs à l’intéressé, le contrôle juridictionnel de la légalité de la décision de refus d’entrée doit être effectué dans le cadre d’une procédure qui met en balance, de manière appropriée, les exigences découlant de la sûreté de l’État et celles du droit à une protection juridictionnelle effective tout en limitant les ingérences éventuelles dans l’exercice de ce droit au strict nécessaire.
