There is no breach of the principle of equal treatment where a vacancy notice published by an EU body provides, first, that if the post is filled by an official he will retain his grade and, second, that if it is filled by secondment of a member of staff of a Member State’s diplomatic service he will be recruited as a member of the temporary staff in grade AD 5, which has the effect of preventing the latter from asserting his seniority, in so far as EU officials and staff of the Member States’ national diplomatic services who are seconded to an EU institution or body are not in an identical or a similar situation as regards the framework within which their career is supposed to progress, or indeed the way in which their administration of origin assesses their seniority.

Similarly, Article 90(1) of the Staff Regulations, which applies to temporary staff pursuant to Article 46 of the CEOS, itself envisages a situation in which, on expiry of the four-month period from the date on which a request is made, the absence of a reply — of its nature without a statement of reasons — is deemed to constitute an implied decision rejecting it, such that the reasons set out by the AECE in that situation can be contested by the temporary staff member only at the contentious stage.

The study came up with a number of recommendations, incl. a better cooperation between key players and universities as well as operators and regulatory bodies in order to mutually optimise their training programmes, a better reporting on the staff situation under the Convention on Nuclear Safety, an increased international and bilateral information exchange on operating experience, the establishment of a post graduate nuclear academy capable to educate graduated engineers in Europe-wide valid principles of nuclear safety, and finally a regular screening of the staff situation in the EU.
