In the present case, it is clear from paragraphs 48, 51 and 52 of the present judgment that both the duties as described in the vacancy notice and the criterion concerning the level of education required of candidates for the vacant post are equivalent, the former to the duties typically entrusted to officials and other staff in grade AD 5 and the latter to the minimum level of education required for appointment as an official or other staff member in that grade.
En l’espèce, il ressort des points 48, 51 et 52 du présent arrêt que tant les tâches telles qu’elles sont décrites dans l’avis de vacance que la condition relative au niveau d’enseignement exigé des candidats au poste à pourvoir équivalent, les premières, aux tâches typiquement confiées à des fonctionnaires et agents de grade AD 5 et, la seconde, au niveau d’enseignement minimal nécessaire pour être nommé fonctionnaire ou agent audit grade.

In the event of the death of a former contract staff member in receipt of an invalidity allowance or a former contract staff member who is in receipt of a retirement pension or who leaves the service before reaching pensionable age and requests that his retirement pension be deferred until the first day of the calendar month following that in which he reached the pensionable age, the persons entitled under the deceased former contract staff member, as defined in Chapter 4 of Annex VIII to the Staff Regulations, shall be entitled to a survivor's pension as provided for in that Annex'.

Where the whereabouts of a contract staff member or of a former contract staff member in receipt of an invalidity allowance or retirement pension, or of a former contract staff member who leaves the service before reaching pensionable age and requests that his retirement pension be deferred until the first day of the calendar month following that in which he reaches pensionable age, are unknown for more than one year, the provisions of Chapters 5 and 6 of Annex VIII to the Staff Regulations dealing with provisional pensions shall apply by analogy to his spouse and to persons recognised as his dependants'.
