Accordingly, in the context of an assessment of merits, it is not until his staff report for the period in respect of which the objectives were set is drawn up that the decision setting those objectives is capable of producing legal effects such as to affect the interests of the official or staff member concerned, by bringing about a distinct change in his legal position, since it is only at that time that the administration can adopt its final position on whether the objectives assigned for that period have been achieved and draw any inferences from that as regards making an assessment of the applicant’s performance in his staff report.

The amendments contained in this opinion pursue three important objectives: (i) providing an operational framework, which can ensure the full independence and loyalty of EEAS staff in the fulfilment of their tasks, in particular as far as staff coming from national diplomatic services are concerned, as they should not be "double-hatted", i.e., respond to both the High Representative and the hierarchy of their national diplomatic service of origin, but they should function solely under the instructions and responsibility of the High Representative, as their appointing authority; (ii) signifying to the High Representative - who, in accordance with Article 6(12) of the Council Decision establishing the EEAS bears the competence to take appropriate measures to provide EEAS staff with adequate common training, building in particular on existing national and EU practices and structures within the year following the entry into force of such Decision - a highly valuable system of training and professional development aimed at creating a true esprit de corps amongst EEAS staff and bringing to bear the northern, eastern and southern academic and research dimensions of the EU; and (iii) ensuring adequate geographical representativity and gender balance in the composition of EEAS staff.

In order for a person to whom the Staff Regulations apply to be permitted, in an action pursuant to Articles 90 and 91 of the Staff Regulations, to request annulment of an act adversely affecting him, within the meaning of Article 90(2), he must at the time of bringing the action have a vested and present and sufficiently clear interest in obtaining the annulment of that act and such an interest presumes that the claim should be capable, by its result, of securing an advantage for him. As a condition of admissibility, the applicant’s interest in bringing proceedings must be evaluated at the time when the action is brought.

For the purposes of the present appeal, it must first be stated that the Civil Service Tribunal recalled that any decision relating to a specific individual which is taken under the Staff Regulations and adversely affects that person must state the reasons on which it is based, on the one hand, to enable the competent court to review the legality of the decision and, on the other, to provide the person concerned with the information necessary to allow him to ascertain whether or not the decision is well founded and to enable him to decide whether to bring an action. It added, however, referring to Case C‑254/95 P Parliament v Innamorati [1996] ECR I‑3423, paragraphs 24 to 28, that, as far as concerns decisions taken by a selection board in a competition, the obligation to state reasons must be reconciled with observance of the secrecy surrounding the proceedings of selection boards by virtue of Article 6 of Annex III to the Staff Regulations, secrecy which was instituted with a view to guaranteeing the independence of selection boards and the objectivity of their proceedings. Thus, observance of this secrecy precludes both disclosure of the attitudes adopted by individual members of selection boards and disclosure of any factors relating to individual or comparative assessments of candidates and that the obligation to state the reasons on which decisions of a selection board in a competition are based must take account of the nature of the proceedings concerned, which, at the stage of examination of the abilities of the candidates, are primarily comparative in character and accordingly covered by the secrecy inherent in those proceedings (paragraphs 30 and 31 of the judgment under appeal).
Aux fins du présent pourvoi, en premier lieu, il convient de relever que le Tribunal de la fonction publique a rappelé que toute décision individuelle prise en application du statut et faisant grief doit être motivée, et que l’obligation de motivation a pour objet, d’une part, de permettre au juge d’exercer son contrôle sur la légalité de la décision et, d’autre part, de fournir à l’intéressé les indications nécessaires pour savoir si la décision est ou non fondée et lui permettre d’apprécier l’opportunité de l’introduction d’un recours. Il a néanmoins ajouté, en faisant référence à l’arrêt de la Cour du 4 juillet 1996, Parlement/Innamorati (C‑254/95 P, Rec. p. I‑3423, points 24 à 28), que, en ce qui concerne les décisions prises par un jury de concours, l’obligation de motivation doit être conciliée avec le respect du secret qui entoure les travaux du jury en vertu de l’article 6 de l’annexe III du statut, secret institué en vue de garantir l’indépendance des jurys de concours et l’objectivité de leurs travaux. Ainsi, le respect de ce secret s’oppose à la divulgation tant des attitudes prises par les membres individuels des jurys que de tous éléments ayant trait à des appréciations de caractère personnel ou comparatif concernant les candidats, et l’exigence de motivation des décisions d’un jury de concours doit tenir compte de la nature des travaux en cause, lesquels, au stade de l’examen des aptitudes des candidats, sont avant tout de nature comparative et, de ce fait, couverts par le secret inhérent à ces travaux (points 30 et 31 de l’arrêt attaqué).

With reference to the disciplinary procedures applying to the other categories of staff, specific provisions need to be adopted as part of the internal implementing measures in order to bring those procedures into line with the specific characteristics of the new type of contract. The amendment to Article 140(3) seeks to ensure this.
