The contracting authority shall accept any other appropriate means of proof than those referred to in paragraph 6, such as a technical dossier from the manufacturer, where the economic operator had no access to the certificates or test reports, or no possibility of obtaining them or obtaining a specific label within the relevant time limits, for reasons that are not attributable to that economic operator and provided that the economic operator concerned proves that the works, supplies or services to be provided fulfil the requirements of the specific label or specific requirements indicated by the contracting authority.

1. Without prejudice to the other requirements of Community law concerning the labelling of foodstuffs, foods falling within the scope of this Section shall be subject to the following specific labelling requirements:

(5) Whereas Regulation (EC) No 258/97 of the European Parliament and of the Council of 27 January 1997 concerning novel foods and novel food ingredients (5), lays down, in Article 8, additional specific labelling requirements in order to ensure proper information for the final consumer; whereas those additional specific labelling requirements do not apply to foods or food ingredients which were used for human consumption to a significant degree within the Community before the entry into force of Regulation (EC) 258/97 and are for that reason considered not to be novel;
(5) considérant que l'article 8 du règlement (CE) n° 258/97 du Parlement européen et du Conseil du 27 janvier 1997 relatif aux nouveaux aliments et aux nouveaux ingrédients alimentaires (5) prévoit des exigences spécifiques supplémentaires en matière d'étiquetage, afin de garantir une information adéquate du consommateur final; que ces exigences spécifiques supplémentaires ne s'appliquent pas aux aliments et ingrédients alimentaires qui ont fait l'objet d'une consommation humaine significative dans la Communauté avant l'entrée en vigueur du règlement (CE) n° 258/97 et qui, de ce fait, ne sont pas considérés comme nouveaux;

Where an economic operator had demonstrably no possibility of obtaining the specific label indicated by the contracting entity or an equivalent label within the relevant time limits for reasons that are not attributable to that economic operator, the contracting entity shall accept other appropriate means of proof, which may include a technical dossier of the manufacturer, provided that the economic operator concerned proves that the works, supplies and services to be provided by it fulfil the requirements of the specific label or the specific requirements indicated by the contracting entity.
