7. The competent authority shall refuse authorisation if it is not satisfied that the members of the management body of the market operator are of sufficiently good repute, possess sufficient knowledge, skills and experience and commit sufficient time to perform their functions, or if there are objective and demonstrable grounds for believing that the management body of the market operator may pose a threat to its effective, sound and prudent management and to the adequate consideration of the integrity of the market.

Those safeguards include arrangements to identify and manage the potential adverse consequences of any conflicts of interest for the operation of the regulated market or its participants; to identify and manage the risks to which they are exposed and to put in place effective measures to mitigate them; to provide for the sound management of the technical operations of their systems establishing effective contingency arrangements to cope with risks of systems disruptions; to have transparent and non-discretionary rules and procedures for fair and orderly trading and establish objective criteria for the efficient execution of orders; to facilitate the efficient and timely finalisation of the transactions executed under their systems; to have available sufficient financial resources to facilitate their orderly functioning, having regard to the nature and extent of the transactions concluded on the market and the range and degree of risks to which they are exposed.

The European Parliament, which has long called for an increased convergence of national supervisory practices and improvement of existing crisis management arrangements in the EU, therefore welcomes both ECOFIN Council Conclusions, and shares the view that a consistency between the evolution of going concern supervisory arrangements, both at national and cross-border levels, and that of crisis management/ financial stability arrangements is needed. Having regard to the two ECOFIN Council Conclusions, and to the still-unfolding financial crisis whose speed and pace has taken by surprise many market participants and supervisors, having regard to the threats the crisis still poses to the EU financial markets and to its spill-over into the EU economy, what does the Presidency consider as appropriate steps to be undertaken in this area in order to better respond to the challenges of globally integrated markets and to preserve the soundness and stability of the EU financial markets?

The European Parliament, which has voiced several calls for increased convergence of national supervisory practices and improvement of existing crisis management arrangements in the EU, welcomes the main actions proposed in the Commission Communication. Having regard to the two ECOFIN Council Conclusions, having regard to the still-unfolding financial crisis whose speed and pace has taken by surprise many market participants and supervisors, and having regard to the threats the crisis still poses to the EU financial markets and to its spill-over into the EU economy, what is the Commission intending to undertake in this area in order to better respond to the challenges of globally integrated markets and to preserve the soundness and stability of the EU financial markets?

The sound market practice favoured by regulators where participants in the financial market use top-up collateral arrangements to manage and limit their credit risk to each other by mark-to-market calculations of the current market value of the credit exposure and the value of the collateral and accordingly ask for top-up collateral or return the surplus of collateral should be protected.
