In the throne speech and in the Prime Minister's response to my questions earlier today, it remains true that the government ignores the legitimate concern of Canadians that trade deals protect core labour standards, basic human rights and our cultural diversity; protect our social programs, particularly the universality of our health care system; protect our natural resources and our primary producers; and protect our environment, including the most life sustaining provisions of all, clean air and safe water.

Irwin Cotler: With regard to international treaties and conventions dealing in whole or in part with human rights and with Canada’s international obligations in this regard: (a) does the government have any formal or informal procedures for regular review of those international human rights treaties that Canada has not yet signed, ratified, or otherwise accepted; (b) does the government have any formal or informal guidelines according to which it determines whether the specific obligations contained in a treaty or other international undertaking conflicts with the Constitution Act, 1867, and if so where can these guidelines be accessed; (c) do the guidelines referred to in (b) specify the standard according to which the government determines if any obligation contained in a treaty or other international undertaking violates any section of the Constitution Act, 1867; (d) has the government engaged in any review of its obligations under the Convention on the Elimination of Racial Discrimination (CERD); (e) does the government have any formal or informal guidelines according to which it determines whether the specific obligations contained in a treaty or other international undertaking require implementing legislation in order for Canada to be able to ratify or otherwise accept it, and if so where can these guidelines be accessed; (f) does the government have a position as to whether international agreements that establish a complaints mechanism or communications procedure for enforcement of the rights and obligations contained therein are necessarily unconstitutional; (g) does the government have a policy as to whether Canada will accept such agreements referred to in (f); (h) does the government undergo review of proposed international human rights agreements that would establish such a mechanism or procedure referred to in (f) on a case by case basis, (i) who is involved in this review, (ii) are the provinces and other inte ...

You ignore the social question – which, you say, should remain the sole responsibility of Member States – but you say nothing about the European Court of Justice, which delivers ruling upon ruling placing the different social models within the Union in competition with each other and basing itself on Articles 43 and 49 of the Treaty.

These usually involve the abolition of price support or a reduction to world market levels; income compensation (partial or full through direct payments; abolition of quotas and other supply management measures; direct income support payments and payments for environmental services on a national basis, with or without Community co-financing. This option certainly has the advantage that it would lead to a considerable simplification and would reduce agricultural expenditure substantially once compensation payments were phased out. Although such a radical reform may be appealing from an economist's point of view, it would imply a number of social and environmental risks which, at least in some regions, could lead to quite negative effects. In addition, at least in the first five to ten years, before compensatory payments are phased out to a large extent, it would imply huge sums of additional public expenditure. Reducing for example milk and sugar prices to bring them close to world market levels would imply drastic price cuts and necessitate some 10000 to 15000 mio ECU for direct payments if full compensation were to be achieved. If direct payments were to be made directly from Member State budgets, the question of economic and social cohesion would arise, and transfer payments between Member States would become necessary to bridge the gap between the richer and the poorer countries and to get the system work. 2.3. Developing the 1992 approach Towards higher competitiveness If the agricultural and agro-food sectors of the Community are to participate fully in the expected favourable world market developments and the expansion of world trade, improved competitiveness will remain a key challenge for the future. Competitiveness has many facets : quality and speciality of the product, value added through processing, services linked to the product, price, etc ...
