4. C. whereas governments bear the primary responsibility for guaranteeing and protecting freedom of expression and the media, notwithstanding the EU’s role in overseeing the application of Article 11 of the EU Charter of Fundamental Rights when Member States are implementing EU law; whereas it is enshrined in EU law, in particular in Protocol No 29 annexed to the TEU, that the system of public broadcasting in the Member States is directly related to the democratic, social and cultural needs of each society and to the need to preserve media pluralism;

I know that when Premiers Blakeney and Peckford proposed the notwithstanding clause in those negotiations, one a New Democrat from Saskatchewan and the other a Progressive Conservative from Newfoundland and Labrador, they did so to both end an impasse and preserve their respective rights to legislate targeted social programs in their provinces without being found to be discriminatory by the courts under the Charter.
