The decision concerns a so-called ‘co-promotion’ agreement (hereafter ‘the agreement’) entered into by Dutch subsidiaries of pharmaceutical undertakings Johnson Johnson and Novartis AG.
La décision concerne un accord dit de «co-promotion» (ci-après l’«accord») conclu par les filiales néerlandaises des entreprises pharmaceutiques Johnson Johnson et Novartis AG.

This case concerns a so-called ‘co-promotion’ agreement between the Dutch originator pharmaceutical company Janssen-Cilag BV, a subsidiary of Johnson Johnson (hereinafter ‘JJ’) and the Dutch generic pharmaceutical companies Hexal BV and Sandoz BV, both of them subsidiaries of Novartis AG at the time of the alleged infringement (hereinafter ‘Novartis/Sandoz’).
La présente affaire concerne un accord dit de «co-promotion» entre la société pharmaceutique néerlandaise de princeps Janssen-Cilag B.V., une filiale de Johnson Johnson (ci-après «JJ»), et les sociétés pharmaceutiques néerlandaises de génériques Hexal B.V. et Sandoz B.V., toutes deux filiales de Novartis AG au moment de l’infraction alléguée (ci-après «Novartis/Sandoz»).

The infringement lasted at least from the date of entry into force of the initial co-promotion agreement on 11 July 2005 until the termination of the co-promotion agreement (including the addendum) on 15 December 2006.
L’infraction a duré, au minimum, depuis la date d’entrée en vigueur du premier accord de co-promotion, le 11 juillet 2005, jusqu’à la cessation de l’accord de co-promotion (y compris l’addendum), le 15 décembre 2006.

During the period covered by the initial co-promotion agreement (from 11 July 2005 to 11 July 2006), Sandoz carried out only limited promotion activities, and for the period covered by the addendum (from 11 July 2006 to 15 December 2006), there is no evidence that any promotion activities were carried out by Sandoz whatsoever.
Au cours de la période couverte par l’accord initial de co-promotion (du 11 juillet 2005 au 11 juillet 2006), Sandoz n’a procédé qu’à des activités de promotion limitées et pour la période couverte par l’addendum (du 11 juillet 2006 au 15 décembre 2006), il n’existe aucun élément de preuve attestant que des activités de promotion ont été menées par Sandoz.

Calls for the European Typology of Homelessness and Housing Exclusion (ETHOS) to be taken into consideration in developing an EU strategy; calls on the Social Protection Committee and its indicators sub-group to promote agreement amongst Member States on applying this definition; calls on EUROSTAT to collect EU homelessness data in the framework of the European Union Statistics on Income and Living Conditions (EU-SILC);

In this context, it is perfectly reasonable to welcome the conclusion of the Competition Agreement whilst calling on the Commission to invest equal effort in promoting agreements to address social and environmental issues that are of direct concern to citizens in the EU and Korea.
