Moreover, the Commission found that Vodafone does not compete with Kabel Deutschland for the retail supply of signal transmission to multiple-dwelling-units and for single-dwelling-units, the increment to the already strong position of Kabel Deutschland would be insignificant, even under the narrowest possible market definition including the activities of both parties (the TV signal transmission via cable and IPTV in the network area of Kabel Deutschland).
La Commission a par ailleurs estimé que Vodafone n’était pas en concurrence avec Kabel Deutschland sur le marché de la fourniture au détail de services de transmission de signaux vers des unités pluri- ou unifamiliales et que la position, déjà forte, de Kabel Deutschland serait à peine renforcée, même selon la définition la plus étroite possible du marché couvrant les activités des deux parties (la transmission de signaux de télévision par câble et l'IPTV dans la zone desservie par le réseau de Kabel Deutschland).
