The Court held that, in any event, even if Freixenet was the first to use the packaging for which registration of the marks was sought, the fact remained that the originality of the packaging did not suffice, since the consumer took account of, and regardless of the time, another element when deciding what to purchase, taking account particularly of the large variety of presentations in the shops.
Le Tribunal a conclu que, en tout état de cause, à supposer même que Freixenet ait été la première à utiliser le conditionnement pour lequel l’enregistrement des marques a été demandé, il n’en demeurait pas moins que l’originalité de ce conditionnement ne suffirait pas, puisque le consommateur tenait compte, et ce quelle que soit l’époque, d’un autre élément pour se décider lors de l’achat, compte tenu notamment de la grande variété de présentations proposée dans les magasins.
